1 Funny Malaysia dan Perak Darul Kartun: Zunar mengalu-alukan keputusan mahkamah

Zunar mendesak kerajaan menghormati keputusan mahkamah secara prinsip dan melepaskan pengharaman terhadap semua buku beliau. (English version below.)

Saya menyambut baik keputusan Mahkamah Rayuan pada 9 Oktober lepas yang menarik balik pengharaman ke atas dua buah buku kartun saya – 1 Funny Malaysia dan Perak Darul Kartun.

Pada Julai 2010, kerajaan mengumumkan pengharaman kedua-dua buku tersebut kerana kandungannya menggugat ketenteraman awam dan boleh mempengaruhi orang ramai supaya merusuh terhadap kerajaan.

Ketika membuat keputusan hakim Muhammad Ariff Yusof, Tengku Maimun Tn Mat dan Varghese a/l G Varughese berkata pihak kerajaan gagal membuktikan bahawa kartun-kartun karya saya dalam buku tersebut bersifat hasutan.

Disamping mengakui bahawa kartun saya “kasar”, hakim Muhammad Ariff berkata namun ia tidak boleh dijadikan alasan kepada kerajaan untuk melabelkan ia sebagai menggugat ketenteraman awam, apa lagi hasutan. Perkara penting yang ditekankan dalam perghakiman tersebut ialah jika pihak kerajaan tidak berpuas hati terhadap kritikan dalam kartun saya, mereka boleh menggunakan undang-undang sivil untuk menyaman saya dan bukan dengan mengharamkan terus buku-buku tersebut.

Saya ingin menegaskan di sini, bahawa sebagai kartunis politik saya bersedia menerima tindakan mahkamah daripada pemimpin-pemimipn kerajaan (termasuk isteri) yang merasakan saya melakukan fitnah terhadap mereka dalam kartun-kartun saya. Saya bersedia mempertahankan karya-karya saya kerana ia dihasilkan setelah homework dan kajian mendalam terhadap fakta dalam sesuatu isu.

Selain itu, saya juga mendesak kerajaan menghormati keputusan mahkamah secara prinsip, iaitu bukan sahaja melepaskan pengharaman terhadap 1 Funny Malaysia dan Perak Darul Kartun, tetapi juga kepada buku-buku saya yang lain. Empat buku saya masih diharam secara rasmi; Gedung Kartun, Isu Dalam Kartun vol 1, Isu Dalam Kartun vol 2 dan isu Dalam Kartun Vol 3. Manakala sebuah lagi buku saya, “Cartoon-O-Phobia” disiasat di bawah Akta Hasutan.

Saya juga mahu kerajaan menghentikan tekanan yang dilakukan terhadap kilang-kilang pencetak yang mencetak buku-buku saya. Setakat ini sudah tiga kilang cetak diserbu oleh pihak kerajaan dan mereka diugut agar tidak lagi mencetak buku-buku saya atau lesen mereka akan ditarik balik.

Ini mengakibatkan tidak ada kilang cetak yang berani mencetak buku saya kecuali dengan tidak mencetak nama mereka di halaman buku yang mana ini bertentangan dengan Akta Mesin Cetak dan Penerbitan. Saya terpaksa mengambil masa selama tiga bulan untuk mendapat pencetak yang berani mencetak buku terbaru saya “Pirate of the Carry-BN” — itu pun percetakan terpaksa dilakukan pada sebelah malam. Saya juga terpaksa menghitamkan nama pencetak bagi melindungi mereka.

Saya juga mendesak kerajaan menghantikan ugutan dan tekanan terhadap pekedai yang menjual buku-buku saya. Dalam serbuan oleh polis dan KDN, pekedai-pekedai diugut akan dihadapkan ke mahkamah di bawah Akta Hasutan dan Akta Mesin Cetak. Ini menyebabkan tidak ada yang berani menjual buku-buku saya yang lain termasuk – “Lawak dan Lawan”, “Even My Pen has A Stand”, “1 Moolaysia” dan “Cartoon-O-Phobia”. Ini bererti. buku-buku ini sebenarnya juga diharamkan, walau tidak secara rasmi. Saya sekarang hanya bergantung kepada jualan minimum belalui website saya, zunar.my.

Saya juga mahu kerajaan memulangkan semua buku-buku saya yang dirampas di kedai-kedai dan juga ketika serbuan ke pejabat saya. Sebanyak 408 naskah “Gedung Kartun” dirampas oleh pihak KDN ketika serbuan di pejabat saya pada September 2009, manakala ratusan yang lain dengan judul berbeza dirampas ketika serbuan di seluruh negara.

Saya juga mahukan kerajaan menghormati kebebasan bersuara dan berkarya seperti yang dijamin dalam Perlembagaan. Kegagalan melakukan ini akan menyebabkan pentadbiran Najib menjadi kerajaan kartun.

Statement on court’s ruling on 1 Funny Malaysia and Perak Darul Kartun

I welcome the decision by the Court of Appeal to lift the ban of my two comic books – 1 Funny Malaysia and Perak Darul Kartun on October 9, 2014. The books were banned on Mei 2010 on the grounds that the contents are detrimental to public order and can influence the public to revolt against the government. I then filed a suit to challenge it, but lost in High Court.

Upon delivering the judgement, Justice Muhammad Ariff Yusof, Tengku Maimun Tn Mat and Varghese a/l G Varughese said the Home Ministry’s contention that the cartoons disturbed public order was not a supportable conclusion by any reasonable criteria.

The government also failed to provide evidence to support any allegations of sedition, or acts having a seditious tendency. Instead, in this case, the law of sedition is being used to control freedom of expression, they added. If these cartoons were contemptuous and defamatory, the aggrieved parties could have filed civil suits to seek remedy.

I would like to make it clear that as a political cartoonist, I am more than ready to face legal action by any leaders if they think that I commit slander against them in my cartoons. I am ready to defend my works because they are produced after long laborious and in-depth studies of facts in any issues.

In addition, I also urge the government to respect the court’s decision in principle: not only to release the ban on ‘1 Funny Malaysia’ and ‘Perak Darul Kartun’, but also on my other books. Four of my other books are still officially banned: ‘Gedung Kartun’, ‘Isu Dalam Kartun Vol 1′, ‘Isu Dalam Kartun Vol 2′ and ‘Isu Dalam Kartun Vol 3′, while ‘Cartoon-O-Phobia’ is investigated under the Sedition Act.

I also want the government to stop the harassment on the printers that print my books. Printing factories have been raided by the government and they are threatened should they get caught printing my books in the future and their printing license will be revoked.

As a result, no printer is willing to print my books anymore except without printing their names in the book, which is contrary to the Printing and Publishing Act. It took me about three months to get a printer who was willing to print my latest book ‘Pirate of the Carry-BN’, and the printing work had to be done at night. I had to blacken the name of the printer in order to protect them.

I also urge the government to stop the intimidation and pressure on vendors and bookstores who sell my books. In a raid by the police and the Home Ministry, they threatened shopkeepers to be charged under the Sedition Act and Printing Presses Act. Due to this, no one dared to sell my books including “Lawak dan Lawan”, “Even My Pen Has a Stand”, “1 Moolaysia” and “Cartoon-O-Phobia”. This means that these books are as good as banned books. I have to depend on very minimun online sales through my website zunar.my.

I also urge the government to return all my confiscated books from the book stores and also during the raid at my office. A total of 408 copies of “Gedung Kartun” were seized by the ministry during the raid at my office in September 2009, while hundreds of others with different titles were seized during raids throughout the country.

I also demand that the government respect the freedom of expression and artistic as guaranteed in the Constitution. Failing to do this, the Najib administration will become merely a cartoon government.
