Pendakwaan ke atas aktivis Cheras Hartamas tidak wajar, tidak masuk akal

[English version below] Suara Rakyat Malaysia (Suaram) sangat mengambil berat di atas pendakwaan terhadap lima individu di bawah Seksyen 186 Kanun Keseksaan kerana penentangan mereka terhadap pembinaan pencawang eletrik berkuasa tinggi di Cheras Hartamas.

Penangkapan terhadap mereka pada 9 Ogos 2016 adalah [tidak wajar] kerana tiada di antara mereka yang menghalang tugas penjawat awam. Mengimbas kembali di mana kelima-lima individu ini memberikan sepenuh kerjasama kepada pihak polis dan agensi lain yang terlibat, pendakwaan mereka di bawah Seksyen 186 kerana menggangu tugas penjawab awam adalah sangat mengecewakan.

Selain itu, tanpa sebarang kesalahan yang dilakukan oleh inidividu ini, bagaimana ‘penjawat awam’ tersebut membuktikan yang mereka telah diganggu semasa menjalankan tugas? Apakah ‘tugas’ yang dikatakan itu, dan bagaimana mereka dikatakan menghalang apabila ‘tugas’ itu sendiri tidak ada? Demikian itu, pendakwaan yang menyatakan mereka menggangu tugas penjawab awam adalah sembrono dan tidak masuk akal.

Disebalik keadaan yang meragukan di dalam pendakwaan mereka, mereka tetap dikenakan bayaran ikat jamin sebanyak RM3,000 seorang.

Suaram menyeru agar pendakwaan terhadap individu-induvidu ini digugurkan serta-merta kerana kes ini sama sekali tidak berasas.

Tambahan pula, Suaram menyeru agar kerajaan negeri Selangor supaya mencari segala saluran untuk menyelesaikan masaalah komuniti yang terjejas dengan pembinaan pencawang elektrik berkuasa tinggi di sekitar kawasan perumahan Cheras Hartamas.

Prosecution of Cheras Hartamas activists unjustifiable, illogical

Suara Rakyat Malaysia (Suaram) is gravely concerned with the prosecution of five individuals under Section 186 of the Penal Code for their activism against the construction of high voltage pylons at Cheras Hartamas.

The initial arrest of the five individuals on 9 August 2016 was unwarranted as none of the five individuals were in any way obstructing the work of public officials. Recounting the fact that these individuals offered their full cooperation with the police and other agencies that may have been involved, it is regrettable that they are now prosecuted under Section 186 for alleged obstruction of public officials.

Furthermore, without any offence committed by these individuals, how did the ‘public officials’ in question justify that they were obstructed in discharging their duties? What is the ‘duty’ in question and how were they obstructed when the ‘duty’ does not exist? As such, the charge which suggest that they obstructed a public official’s duty can only be described as frivolous and illogical.

Despite the curious circumstances surrounding their prosecution, they were required to post bail of RM3,000 per person.

Suaram calls for the charges against these individuals to be dropped immediately as there are no merit to the case. Furthermore, Suaram calls on the Selangor state government to explore all avenues of redress available for the community affected by the construction of high voltage pylons around the residential area of Cheras Hartamas.
