Gubal undang-undang peruntukan ahli Parlimen (Malay/English)

[ENGLISH VERSION BELOW] Gabungan Pilihan Raya Bersih dan Adil (Bersih 2.0) mengalu-alukan kenyataan Timbalan Menteri di Jabatan Perdana Menteri Mastura Mohd Yazid di Dewan Rakyat pada 23 September 2021 yang memaklumkan bahawa kerajaan persekutuan akan memberikan peruntukan pembangunan kawasan (constituency development fund) kepada semua ahli Parlimen termasuk pembangkang.

Peruntukan tersebut akan disalurkan bermula September hingga Disember tahun ini.

Keputusan untuk memberikan peruntukan secara adil ini adalah bertepatan dengan semangat Parlimen dan demokrasi di mana wakil rakyat berhak dilayan secara adil bagi memberi khidmat sepenuhnya kepada rakyat di kawasan mereka. Keputusan ini juga memperlihatkan kesanggupan kerajaan persekutuan mendengar pandangan-pandangan Bersih 2.0 dan parti pembangkang lain supaya peruntukan diberikan kepada semua tanpa diskriminasi.

Memorandum Persefahaman transformasi dan kestabilan politik yang dicapai antara Pakatan Harapan dan kerajaan persekutuan hanya bersetuju memberikan peruntukan kepada parti-parti yang menandatangani Memorandum Persefahaman tersebut.

Namun, keputusan yang baik ini tidak boleh hanya dilaksanakan apabila berlaku pergolakan politik atau dasar budi bicara perdana menteri yang ingin memberikan peruntukan yang adil kepada semua ahli Parlimen.

Bersih 2.0 mengulangi gesaan kami untuk kerajaan persekutuan segera menggubal satu undang-undang peruntukan pembangunan kawasan bagi memastikan peruntukan kepada semua wakil rakyat diberikan secara sama rata dan berterusan, serta bukannya atas dasar ihsan mana-mana pihak.

Undang-undang peruntukan pembangunan kawasan selain memastikan peruntukan diberikan secara sama rata, juga perlu menyatakan formula peruntukan untuk setiap kawasan; sumber kewangan dalam belanjawan tahunan; had peruntukan tahunan peruntukan pembangunan kawasan; keperluan agensi dan wakil rakyat untuk menyiarkan maklumat utama peruntukan pembangun kepada orang ramai; mekanisme penyertaan orang ramai dalam perumusan, pelaksanaan dan pemantauan peruntukan pembangunan kawasan; serta sekatan kepada penyalahgunaan atau penggelapan peruntukan pembangunan kawasan.

Selain itu, semua kerajaan negeri juga perlu mencontohi tindakan kerajaan persekutuan dan juga kerajaan negeri Perak yang merupakan negeri pertama memberikan peruntukan yang saksama kepada semua wakil rakyat di dewan. Kerajaan-kerajaan negeri perlu menyalurkan peruntukan yang saksama dengan menggubal satu ordinan peruntukan pembangunan kawasan agar wakil rakyat di peringkat negeri dapat membantu rakyat di kawasan mereka terutama semasa musim Covid ini.

Reformasi-reformasi yang dipersetujui antara kerajaan dan Pakatan Harapan serta yang telah banyak didesak oleh banyak pihak termasuk Bersih 2.0 tidak cukup sekadar dilaksanakan atas dasar budi bicara kerajaan. Ia perlu diinstitusikan segera melalui penggubalan undang-undang agar semua pihak dapat melakukan semak dan imbang yang berkesan sekaligus mengukuhkan institusi Parlimen yang sekian lama dilemahkan. – Bersih 2.0

Equal constituency development funds should be law and not based on government goodwill

The Coalition for Clean and Fair Election (Bersih 2.0) welcomes Deputy Minister in the Prime Minister’s Department Mastura Mohd Yazid’s announcement in the Dewan Rakyat on 23 September 2021 that the federal government will provide equal constituency development funds to all MPs including the Opposition.

The funds will be disbursed from September to December this year.

This decision to allocate equal funding is in keeping with the parliamentary and democratic spirit, in which elected representatives should be treated fairly to ensure they can serve their constituencies properly.

This decision also shows the willingness of the federal government to take heed of the views of Bersih 2.0 and opposition parties to provide funding to all without discrimination. The Memorandum of Understanding for transformation and political stability achieved by the federal government and Pakatan Harapan only agreed to give equal allocation to the parties who signed the Memorandum of Understanding.

Nonetheless, this positive move of giving equal allocations should not happen only because of the current political impasse; neither should it be dependent on the PM’s goodwill.

Bersih 2.0 reiterates our call for the federal government to immediately enact a constituency development funds act to ensure equal and continual allocations are provided to all elected representatives regardless of who is the prime minister. Besides ensuring that allocations are given equally, the constituency development funds act must also stipulate the allocation formula for each constituency; the source of financing in the annual budget; the limit of the amount allocated for constituency development funds annually; requirements for relevant agencies and lawmakers to publish key information about constituency development funds to the public; mechanisms for public participation in the formulation, implementation and monitoring of the constituency development funds; and sanctions for misusing or embezzling these funds.

All the state governments should also follow the federal government and Perak state government, which was the first state to give equal constituency development funds to all elected representatives. The state governments should provide equal funds to help their state assembly members to serve their state constituencies, especially during the Covid outbreak.

The reforms agreed to between the government and PH have been advocated by many organisations, including Bersih 2.0 but it is not enough that they are implemented administratively at the government’s discretion. It has to be institutionalised immediately through the drafting of legislations so that there is a level playing field for all parties and they can be effective checks and balances while strengthening the institution of Parliament. – Bersih 2.0
