[ENGLISH VERSION BELOW] Eliminating Deaths and Abuse in Custody Together (Edict) difahamkan pada 25 Jun, kira-kira jam 12.30 tengahari, satu lagi kematian dalam tahanan berlaku di lokap IPD Dang Wangi, Kuala Lumpur.
Mangsa merupakan seorang lelaki warganegara Malaysia dalam usia 40an.
Setakat jam 8 pagi 26 Jun, Edict tidak menemui apa-apa kenyataan berkenaan kematian beliau.
Ini adalah kali kedua kematian dalam tahanan berlaku di lokap polis daerah Kuala Lumpur pada bulan Jun. (Kes yang pertama adalah kematian “Dhan Bahadur” pada 2 Jun di lokap berpusat Jinjang.)
Menurut jawapan dalam sidang parlimen, purata kehilangan 16 nyawa telah berlaku setiap tahun dalam lokap polis di Malaysia.

Keterangan yang dikemukakan dalam prosiding-prosiding inkues telah menunjukkan bahawa terdapat kegagalan sistemik dalam penyiasatan polis. Ini adalah waktunya untuk ketua polis negara dan menteri dalam negeri mengambil langkah yang kukuh untuk menghentikan kematian dalam tahanan.
Memandangkan kematian dalam tahanan kerap kali berlaku, Edict menggesa Ketua Polis Hamid Bador dan Menteri Dalam Negeri Hamzah Zainuddin untuk mengambil langkah yang perlu bagi memastikan siasatan kes kematian dalam tahanan dijalankan secara bebas, profesional dan pantas. Sekurang-kurangnya mereka perlu:
Mewujudkan senarai pengawai penyiasat kebangsaan bagi kes-kes kematian dalam tahanan untuk setiap negeri, dan pegawai penyiasat tersebut sekurang-kurangnya berpangkat penolong ASP (assistant superintendent)
Melantik seorang pegawai polis daripada senarai tersebut sebagai pegawai penyiasat bagi mana-mana kes kematian dalam tahanan dalam tempoh dua jam daripada masa kematian dilaporkan. Sistem giliran digunakan untuk memilih pegawai penyiasat bagi mengelakkan unsur berat sebelah – dan semestinya memastikan bahawa tiada konflik kepentingan dalam pemilihan pegawai
Memastikan pegawai penyiasat tersebut melaporkan kepada pihak atasan di dalam negeri yang beliau bertugas, bukan di dalam negeri berlakunya kematian dalam tahanan tersebut
Memastikan pegawai penyiasat segera berada di lokasi kejadian, tidak melebihi tempoh 12 jam daripada masa kematian dilaporkan
Memastikan pegawai penyiasat mengumpul kesemua bukti (gambar, lakaran, diari siasatan polis, rakaman CCTV, kenyataan saksi) dalam tempoh 72 jam daripada masa kematian dilaporkan – ini memerlukan penempatan pegawai yang mencukupi di bawah arahan pegawai penyiasat, gerak kerja yang pantas oleh bahagian forensik polis dan kerjasama yang mantap daripada agensi-agensi berkenaan seperti Jabatan Kimia dan Mimos
Menyediakan latihan kepada pegawai penyiasat bagi kes kematian dalam tahanan tersebut mengenai inkues sepertimana yang termaktub di dalam Kanun Prosedur Jenayah (Seksyen 328-341A) dan dapatan koroner dalam kes-kes sebelumnya
Menyertakan di dalam terma rujukan untuk pegawai penyiasat, pengumpulan bahan bukti untuk membantu koroner dalam membuat keputusan berkenaan tindakan dan peninggalan yang salah yang menyebabkan kematian dalam tahanan
Dalam kes kematian di Dang Wangi semalam, kami menggesa ketua polis Kuala Lumpur untuk menamakan pegawai penyiasat, struktur laporan dan tarikh sasaran yang diberikan kepada pegawai penyiasat bagi melengkapkan laporan siasatan untuk dihantar kepada koroner
Budaya memperlakukan nyawa manusia seperti objek yang tidak bernilai mesti dihentikan.

Second death in police custody in Kuala Lumpur in June
Eliminating Deaths and Abuse in Custody Together (Edict) has learned that on 25 June, about 12.30 pm, another person died in custody in the Dang Wangi lock-up in Kuala Lumpur.
The victim is said to be a male Malaysian citizen in his mid-forties.
As of 8am on 26 June, Edict could not locate any statement by the police concerning his death.
This was the second death in custody in the Kuala Lumpur police district last month. (The first was “Dhan Bahadur” on 2 June, in the Jinjang lock-up.)
According to parliamentary responses, an average of 16 lives are lost every year in police lock-ups in Malaysia.
Evidence at inquests shows systemic failures in police investigations. It is high time the inspector general of police and the home minister take concrete steps to end deaths in custody.
Because of the frequency of deaths in custody, Edict calls upon Inspector General Hamid Bador and Home Minister Hamzah Zainudin to take steps to assure that investigations of deaths in custody are independent, professional and fast-tracked. Minimally, they should:
Establish a national list of investigating officers for deaths in custody, preferably one from each state, of at least assistant superintendent in rank
Appoint an officer from the national list as investigating office for any case of a death in custody within two hours of the reported time of death. Use a rotation system to select the investigating office to avoid suggestions of bias – provided of course that there are no conflicts of interest in the choice of officer
Require that the investigating officer must report to superiors in his own state, not in the state where the death in custody occurred
Require the investigating officer to be on-site as soon as possible, but no later than 12 hours from the reported time of death
Require the investigating officer to gather all evidence (photos, sketches, copies of police diaries, CCTV recordings, witness statements) within 72 hours of the reported time of death – this requires the placing of sufficient officers under the officer’s command, fast-tracking of work by police forensics officers and enhanced cooperation from agencies such as the Chemistry Department and Mimos
Provide training to the investigating officer handling deaths in custody about the inquest process mandated by the Criminal Procedure Code (Sections 328-341A) and coroner’s findings in previous cases of deaths in custody
Include in the terms of reference for the investigating officers, evidence gathering to assist coroners to make decisions regarding unlawful acts or omissions which may have led to the death.
In this instance of a death in custody in Dang Wangi on 25 June, we call upon the chief police officer of Kuala Lumpur, Mazlan Lazim, to name the investigating officer, the reporting structure and the target date given to the investigating officer for submission of the completed investigation report to the coroner.
The culture of treating lives like inanimate objects must end.

Death in custody has been a perennial problem for decades yet it is not taken seriously by the authorities as well as the society at large. Whenever such deaths happen only edict and few other NGO’s issue press statements thereafter the whole incident forgotten. Even the Bar Council lately has been very quite. I wonder what is going on in this country.
