Ketidakpastian dalam isu mahkamah Syariah sesuatu kebimbangan bagi wanita ketika perintah kawalan pergerakan (Malay/English)

[ENGLISH VERSION BELOW] Sisters in Islam (SIS) masih beroperasi berikutan perlanjutan perintah kawalan pergerakan sehingga 28 April 2020.

Talian Telenisa kami, perkhidmatan yang menawarkan khidmat nasihat guaman yang berlandaskan undang-undang keluarga Islam dan undang-undang jenayah Syariah telah dilanjutkan tempoh operasinya iaitu dari hari Isnin ke Jumaat, 8 pagi hingga 10 malam. Talian Telenisa juga telah dipindahkan ke talian sementara di 011-2370 1006 ketika tempoh perintah kawalan pergerakan.

Perlanjutan waktu operasi kami adalah berdasarkan klien kami yang majoritinya adalah wanita. Oleh yang demikian, wanita yang merupakan ibu, anak perempuan dan isteri mungkin sibuk menjaga keluarga dan tanggungan mereka pada siang hari dan oleh itu, ketersediaan lanjutan waktu operasi kami di luar waktu pejabat dapat memberikan akses perkhidmatan kami yang lebih baik kepada mereka.

Selain itu, perlanjutan ini juga berdasarkan kes-kes pergolakan perkahwinan atau keluarga dan terutamanya di mana terdapat penderaan atau keganasan yang terlibat, mangsa hanya mempunyai pilihan yang terbatas untuk mendapatkan bantuan dan sokongan.

Oleh itu, kami ingin memaklumkan kepada orang ramai bahawa kami masih ada untuk memberi bantuan dan bersama-sama dengan kami, beberapa talian NGO lain serta Talian Kasih 15999 yang dibangunkan oleh Kementerian Pembangunan Wanita, Keluarga dan Masyarakat (KPWKM).

Berkaitan dengan isu-isu Syariah yang mempengaruhi penduduk Islam di Malaysia, Jabatan Kehakiman Syariah Malaysia telah mengumumkan pada 25 Mac 2020 bahawa majoriti perkara dalam bidang kuasanya akan dijalankan secara atas talian.

Klien yang kami terima sepanjang perjalanan perintah kawalan pergerakan telah menyuarakan ketidakpastian mereka dari segi kedudukan mereka di bawah undang-undang. Perkara-perkara yang dibangkitkan termasuk:

  • Bagaimanakah isu-isu yang tertangguh di mahkamah akan ditangani semasa perintah kawalan pergerakan? Sebagai contoh, salah seorang klien kami mempunyai perintah penjagaan interim yang akan luput pada masa perintah kawalan pergerakan. Oleh itu, dia tidak dapat memohon melanjutkan perintah mahkamah itu dan dia tidak dapat membuat pendengaran untuk perintah kekal. Apakah kedudukannya sekarang?
  • Bagaimanakah hak lawatan seseorang ibu atau bapa akan dijalankan? Dalam masa perintah kawalan pergerakan, beberapa klien kami tidak dapat bergerak dengan bebas untuk menghantar atau mengambil anak-anak mereka untuk hak lawatan. Dalam satu kes, anaknya sakit dan menimbulkan kerisauan akan risiko mendedahkan anaknya kepada virus Covid-19 akibat pemindahan anaknya ke rumah lain. Adakah ini telah diselaraskan dengan pihak berkuasa lain seperti polis?
  • Nafkah masih menjadi masalah. Dalam banyak kes, klien kami tidak mempunyai akaun bank untuk pemindahan wang atas talian, dan penghantaran secara fizikal nafkah tersebut dalam tempoh perintah kawalan pergerakan adalah terbatas
  • Seorang klien risau bahawa kes perceraiannya masih tertangguh di mahkamah dan dia tidak dapat makluman dari pihak mahkamah sama ada tarikh baru telah ditetapkan untuknya
  • Perkara yang berkaitan dengan keganasan rumah tangga masih menjadi isu utama di mana pertanyaan untuk tempat perlindungan, laporan polis dan sebagainya masih menjadi isu

Kami menggesa untuk penjelasan yang jelas dan muktamad mengenai cara penyelesaian bagi kes-kes seperti di atas dari Jabatan Kehakiman Syariah Malaysia untuk menangani pertanyaan di atas. Adalah penting bahawa maklumat disebarkan secara meluas kepada orang ramai untuk memastikan orang yang terlibat mengetahui kedudukan mereka di bawah undang-undang Syariah. Kami menggesa pihak berkuasa untuk memberikan perhatian kepada perkara ini dengan segera.

Uncertainty over Sharia court matters a concern for women during movement control order

In light of the extension of the movement control order until 28 April 2020, Sisters in Islam (SIS) continues to remain operational as usual.

Our Telenisa service, a free legal helpline that provides a non-judgemental and rights-based advisory service on Islamic family and Sharia laws has been extended Monday to Friday from 8am to 10pm and has been moved to a temporary phone number at 011-2370 1006 during the movement control order period.

The extension of the hours is based on our clients, the majority of whom are women. That being so, women who are mothers, daughters and wives may be busy caring for their families and dependents during the day and thus, the availability of our helpline after hours may afford them greater accessibility to our services.

Furthermore, the extension is also based on cases on marital or family disruption, especially when abuse or violence is involved, the victims may only have a short window of opportunity to reach out for help and support. We remain concerned that those in need of assistance are unable to obtain the help they need.

Thus, we would like to inform the public that we, together with a number of NGOs and Talian Kasih 15999, which is coordinated by the Ministry of Women, Family and Community Development, remain available to provide assistance.

In relation to Sharia matters that affect Muslims in Malaysia, the Malaysian Sharia Judicial Department has announced on 25 March 2020 that the majority of matters within its jurisdiction will be conducted online.

The clients we have received over the course of the movement control order have voiced their uncertainty in terms of their position under the law. Matters that were brought up include:

  • How will matters that were due in court during the time of the movement control order be dealt with? For example, one of our clients had an interim custody order, which was due to expire during the time of the movement control order. Thus, she is unable to have an extension of that court order nor is she able to have a hearing for a permanent order. What is her position now?
  • How will visitation rights of one spouse be treated? With the movement control order, some of our clients are unable to move freely to send or pick up their children for visitation rights. In one case, her child was ill, and thus she was very concerned about exposing her child to the Covid-19 virus as a result of her child travelling to another house. Are visitation rights one of the permitted reasons for travel? Has this been coordinated with other authorities such as the police?
  • Maintenance remains an issue. In many cases, our clients do not have bank accounts, thus a transfer of money may not be possible, and with the movement control order, physical delivery of the maintenance support may not be possible
  • One client is concerned that her divorce case is pending during the movement control order, and she has not heard from the courts whether a new date has been set for it
  • Matters related to domestic violence remain a major issue where queries for shelter, police reports and so on are still common

We urge that there be clear and definitive clarifications on the treatment of cases such as the above from the Malaysian Sharia Judiciary Department to deal with the queries above. It is imperative that the information is disseminated widely to the public to assure the persons affected of their position under the Sharia laws. We urge the authorities to provide attention to this matter urgently.
