[ENGLISH VERSION BELOW] Pertubuhan Pertolongan Wanita (WAO) mengalu-alukan pengumuman kerajaan bahawa kertas kerja kabinet menjenayahkan tindakan menghendap kini sedang dalam perancangan.
Pengumuman yang diumumkan oleh Rina Harun, Menteri Pembangunan Wanita, Keluarga dan Masyarakat (KPWKM), di Dewan Rakyat pada 21 Julai 2020, dalam maklum balas bertulis kepada soalan daripada Ahli Parlimen Batu Kawan Kasthuri Patto mengatakan kertas kerja kabinet kini sedang disediakan oleh Bahagian Hal Ehwal Undang-Undang (BHEUU), Jabatan Perdana Menteri.
Kami menyeru kerajaan, khususnya Rina Harun dan Menteri Undang-Undang Takiyuddin Hassan supaya mengutamakan penggubalan undang-undang ini.
Dengan menjenayahkan tindakan menghendap akan melindungi rakyat Malaysia, selaras dengan amalan antarabangsa dan ianya disokong penuh oleh petugas barisan hadapan kerajaan dan NGO.
Menghendap bukanlah satu jenayah di Malaysia. Oleh itu, sekiranya seseorang berkali-kali menghubungi, mengekori atau kerap kali muncul di tempat anda – yang mana ianya mendatangkan ketakutan atau tekanan emosi – tidak banyak yang boleh dilakukan oleh pihak berkuasa. Sekarang juga masih belum ada peruntukan undang-undang untuk mangsa hendap mendapatkan perintah menjauhkan diri.

Menjenayahkan menghendap akan meletakkan Malaysia selaras dengan amalan antarabangsa. Negara-negara yang sudah memiliki peruntukan undang-undang mengenai menghendap termasuklah Filipina, Jepun, Australia, Afghanistan, India, Singapura, Mongolia, Amerika Syarikat, Kanada, New Zealand, Afrika Selatan, Jerman, Republik Czech dan Britain.
Penggubalan undang-undang ini telah bermula sejak 2019. Proses ini telah dikoordinasikan oleh jawatankuasa yang terdiri daripada pihak-pihak berkepentingan yang pelbagai termasuklah BHEUU, KPWKM, polis, Pejabat Peguam Negara, Jabatan Kebajikan Masyarakat, Suruhanjaya Komunikasi dan Multimedia, Kementerian Dalam Negeri, Majlis Peguam Malaysia dan WAO.
Menggubal undang-undang perlindungan terhadap menghendap telah menerima sokongan tidak berbelah bagi daripada ramai Ahli Parlimen dari setiap parti politik. Ahli-ahli Parlimen di bawah telah memberi sokongan terbuka dalam menjenayahkan menghendap:

WAO welcomes the government’s commitment to push forward anti-stalking legislation
Women’s Aid Organisation (WAO) welcomes the government’s announcement that a cabinet paper on making stalking an offence is being prepared.
This announcement was made by Rina Harun, the Minister for Women, Family and Community Development (KPWKM), in the Dewan Rakyat on 21 July 2020, in a written reply to a question from Batu Kawan MP Kasthuri Patto. The cabinet paper is being prepared by the Legal Affairs Division of the Prime Minister’s Office (BHEUU).
We urge the government, in particular Rina Harun and Law Minister Takiyuddin Hassan to prioritise this legal reform. Making stalking an offence will protect Malaysians. It is also in line with international practice and is supported by government frontline staff and NGOs, and enjoys bipartisan support.
Stalking is currently not a crime in Malaysia, so if someone repeatedly contacts you, follows you, or shows up at places you frequent – in a way that would reasonably cause fear or emotional distress – there is little that the authorities can do. There is also no legal provision for stalking survivors to obtain a restraining order.
Making stalking an offence will put Malaysia in line with international practice. Countries that have specific legal provisions on stalking include, for example, the Philippines, Japan, Australia, Afghanistan, India, Singapore, Mongolia, the US, Canada, New Zealand, South Africa, Germany, the Czech Republic and the UK.
This legal reform began in 2019. The process has been coordinated by a multi-stakeholder committee, which includes BHEUU, KPWKM, the police, the Attorney General’s Chambers, the Welfare Department, the Malaysian Communications and Multimedia Commission, the Ministry of Home Affairs, the Bar Council and the WAO.
Creating laws to protect against stalking has received bipartisan support from various MPs across the political divide. The following MPs have publicly stated their support for making stalking an offence:
