[ENGLISH VERSION BELOW] Beberapa pertubuhan masyarakat sivil di Pulau Pinang bersatu dalam menunjukkan sokongan dan solidariti kepada penduduk Sungai Ara, yang telah menfailkan rayuan ke Mahkamah Persekutuan, dalam perjuangan mereka menentang projek Sunway City di kawasan tanah bukit yang sensitif alam sekitar.

Perbicaraan Mahkamah Persekutuan akan berlangsung pada 25-26 Mei 2022 dan merupakan kes kepentingan awam yang amat ketara, memandangkan ia melibatkan aspek undang-undang perancangan dan perlindungan tanah dan cerun bukit daripada pembangunan, bukan hanya di Pulau Pinang tetapi juga di seluruh negara.

Sejak beberapa tahun dan kebelakangan ini, kita telah menyaksikan kejadian tanah runtuh dan kegagalan cerun bukit yang telah menyebabkan kehilangan nyawa, kecederaan manusia dan kerosakan harta benda di Pulau Pinang dan seluruh negara.

Projek Sunway Hills oleh Sunway City di Sungai Ara melibatkan pembangunan perumahan di kawasan tanah bukit yang sensitif, iaitu tanah dengan ketinggian lebih daripada 250 kaki (76m) di atas paras laut dan kecerunan melebihi 25 darjah.

Penduduk dari Kondominium Sunrise Garden dan perumahan bertanah yang tinggal di kaki bukit berhampiran projek yang dicadangkan telah membawa rayuan ini ke Mahkamah Persekutuan kerana bimbang akan keselamatan dan kesannya kepada alam sekitar.

Sunway City bercadang untuk membina 600 unit terdiri daripada pangsapuri bertingkat dan banglo di tanah bukit meliputi kawasan seluas 80 ekar; kira-kira 43% daripadanya adalah di atas cerun yang melebihi 25 darjah.

Pada 20 November 2015 Lembaga Rayuan, di bawah Akta Perancangan Bandar dan Desa 1976 (TCPA), mendukung bantahan oleh penduduk terhadap kelulusan projek dan kebenaran merancang yang diberikan oleh Majlis Bandaraya Pulau Pinang (MBPP).

Sunway City berhujah bahawa MBPP memberikan kebenaran merancang bagi projek itu dengan betul kerana pembangunan yang dicadangkan itu adalah ‘projek khas’.

Penduduk berhujah bahawa tanah bukit yang sensitif adalah tidak sesuai untuk pembanguan yang dicadangkan itu.

Lembaga Rayuan memutuskan bahawa MBPP adalah salah dalam memberikan kelulusan, kerana ia gagal mempertimbangkan dengan betul bahawa (dalam kes ini), objektif utama Rancangan Struktur Pulau Pinang 2020 adalah untuk memelihara tanah bukit; dan hanya pengecualian yang sangat terhad dan wajar dibenarkan sebagai ‘projek khas’, yang mana justifikasinya kurang dalam projek Sunway.

Rancangan Struktur Pulau Pinang 2020 diwartakan pada 2007 dan menyatakan bahawa tanah bukit lebih daripada 250 kaki (76m) dari paras laut dan/atau dengan kecerunan melebihi 25 darjah tidak boleh diluluskan untuk pembangunan, kecuali dalam kes di mana ia melibatkan ‘projek khas’. Rancangan struktur bagaimanapun tidak mentakrifkan apa itu ‘projek khas’.

Takrifan dan garis panduan untuk ‘projek khas’ telah diluluskan oleh kerajaan negeri Pulau Pinang pada 2009.

Bagaimana garis panduan itu ditafsirkan adalah intipati pertikaian dalam kes penduduk Sungai Ara.

Daripada terus berkecuali, MBPP, dengan sokongan kerajaan negeri Pulau Pinang, telah memihak kepada Sunway dalam mencabar keputusan Lembaga Rayuan.

Pada 2017 Sunway City dan MBPP memfailkan permohonan semakan kehakiman kepada Mahkamah Tinggi Pulau Pinang terhadap keputusan Lembaga Rayuan; dan pada 29 Mei 2017, keputusan Mahkamah Tinggi memihak kepada Sunway City dan MBPP.

Pada Jun 2017 penduduk Sungai Ara memfailkan rayuan kepada Mahkamah Rayuan, mencabar keputusan Mahkamah Tinggi.
Bagaimanapun, Mahkamah Rayuan menyampaikan keputusannya hanya pada 21 Mei 2021 (lebih dua tahun selepas rayuan didengar) dan bersetuju dengan Mahkamah Tinggi dan memberi keputusan yang memihak kepada Sunway City.

Justeru, penduduk telah membuat rayuan ke Mahkamah Persekutuan.

Kami, sebagai kumpulan yang prihatin, menyatakan sokongan dan solidariti kami kepada penduduk Sungai Ara dalam rayuan mereka, memandangkan kes ini memberikan implikasi yang serius bukan sahaja kepada penduduk berhampiran yang tinggal di sekitar projek itu, tetapi juga kepada semua rakyat Pulau Pinang dan Malaysia yang akan terjejas dengan projek pembangunan di kawasan sensitif alam sekitar terutamanya di kawasan bukit dan tanah tinggi.

Memandangkan keputusan Mahkamah Persekutuan juga akan turut berkaitan dengan undang-undang perancangan di negara ini mengenai isu rancangan struktur dan rancangan tempatan, implikasi kes ini adalah ketara kepada semua rakyat tentang bagaimana kebenaran merancang projek diberikan, terutamanya projek berkaitan dengan kawasan sensitif alam sekitar seperti tanah bukit.

Turut menjadi kepentingan yang amat kritikal ialah isu bagaimana MBPP boleh mencabar keputusan Lembaga Rayuan yang ditubuhkan di bawah TCPA.

Ini adalah satu perkara yang amat serius yang melibatkan kepentingan awam, yang memerlukan perhatian orang ramai dan semua kumpulan yang prihatin.

Kami memuji semangat dan keberanian penduduk Sungai Ara dalam menerajui rayuan penting ini ke Mahkamah Persekutuan, walaupun mereka menghadapi cabaran kewangan.

Perjuangan mereka demi kepentingan awam perlu disokong untuk persekitaran dan Pulau Pinang yang lebih baik, dan kita akan melihat dengan penuh harapan hasil keputusan prosiding Mahkamah Persekutuan ini.

Civil society groups express support for Sungai Ara residents’ case against Sunway Hills project on environmentally sensitive hills

Several civil society organisations in Penang have come together in a show of solidarity and support for the Sungai Ara residents, who have filed an appeal to the Federal Court, in their fight against the Sunway City project which is on environmentally sensitive hill lands.

The Federal Court hearing will take place on 25-26 May 2022 and is of significant public interest, as it involves aspects of planning law and the protection of hill lands and hill slopes from development, not only in Penang but also in the country.

Over the years and in recent times, we have witnessed landslides and hill-slope failures involving the loss of innocent lives, human injuries and damage to property in Penang and all over the country.

The Sunway Hills project by Sunway City in Sungai Ara involves housing development on sensitive hill land, that is, land with more than 250 feet (76m) above sea level and a gradient exceeding 25 degrees.

The residents from Sunrise Garden Condominium and a landed property who live in the foothills of the proposed project have brought this appeal to the Federal Court due to environmental and safety concerns.

Sunway City proposes to construct 600 high-rise apartments and bungalows on hill lands covering 80 acres, about 43% of which are on slopes exceeding a gradient of 25 degrees.

On 20 November 2015 the Appeals Board, under the Town and Country Planning Act 1976 (TCPA), upheld the objections by the residents against the approval of the project and the grant of planning permission by Penang Island City Council (MBPP).

Sunway City had argued that MBPP had granted planning permission for the project properly because the proposed development is a ‘special project’.

The residents argued that the sensitive hill lands are unsuitable for the development proposed.

The Appeals Board ruled MBPP was wrong in granting the approval, as it had failed to consider properly that (in this case), the primary objective of the Penang Structure Plan 2020 is to preserve hill lands; and only very limited and justifiable exceptions were allowed as ‘special projects’, the justification for which was lacking in the Sunway project.

The Penang Structure Plan 2020 was gazetted in 2007 and states that hill lands more than 250 feet (76m) above sea level and/or with a gradient exceeding 25 degrees cannot be approved for development, except in cases where they involve ‘special projects’. The Structure Plan, however, did not define ‘special projects’.

The definition and the guidelines for ‘special projects’ were approved by the Penang state government in 2009.

How the guidelines are to be interpreted is the crux of the dispute in the Sungai Ara residents’ case.

Instead of remaining neutral, MBPP, with the support of the Penang state government, has sided with Sunway in challenging the Appeals Board’s decision.

In 2017 Sunway City and MBPP filed a judicial review application to the Penang High Court against the decision of the Appeals Board; and on 29 May 2017 the High Court decided in favour of Sunway City and the MBPP.

In June 2017 the Sungai Ara residents filed an appeal to the Court of Appeal, challenging the decision of the High Court.

However, the Court of Appeal delivered its decision only on 21 May 2021 (more than two years after the appeal was heard), and agreed with the High Court and ruled in favour of Sunway City.

Hence, the residents have appealed to the Federal Court.

We, as concerned groups, express our solidarity and support for the Sungai Ara residents in their appeal, as this case has serious implications not only for the residents living in the immediate vicinity of the project but also for all citizens of Penang and Malaysia who will be affected by development projects in environmentally sensitive areas, especially on hill lands and highlands.

Since the decision of the Federal Court will also deal with planning law in the country on the issue of structure plans and local plans, the implications of this case will be significant for all citizens on how planning permission for projects is granted, particularly as regards environmentally sensitive areas such as hill lands.

Also of critical importance is the issue of how MBPP could challenge a decision of the Appeals Board set up under the TCPA.

These are serious matters of public interest, which require the attention of all concerned groups and members of the public.

We laud the spirit and courage of the Sungai Ara residents in spearheading this important appeal to the Federal Court, despite the financial challenges they are facing.

Their struggle in the public interest should be supported for a better environment and a better Penang, and we will watch with utmost interest the outcome of the Federal Court proceedings.
