Lantik pengerusi SPR yang reformis dan bebas (Malay/English)

[ENGLISH VERSION BELOW] CSO Platform for Reform ingin menyuarakan kebimbangan kami dalam proses pelantikan pengerusi Suruhanjaya Pilihan Raya (SPR) yang seterusnya apabila Ghani Salleh yang dijadualkan bakal bersara wajib pada bulan Mei ini bersekali dengan satu kekosongan jawatan ahli pesuruhjaya SPR Sabah.

Pelantikan pengerusi SPR yang pakar tentang pilihan raya, reformis dan bebas penting kerana beliau akan bertanggungjawab ke atas proses persempadanan semula Sarawak (sedang berjalan), Sabah (2025), dan di semenanjung (2026), yang merupakan aspek penting dalam pembentukan lanskap demokrasi negara.

CSO Platform for Reform konsisten dengan pendirian kami supaya kerajaan “Madani” melaksanakan sebuah pemilihan yang telus, terbuka dan inklusif bagi mengisi kekosongan jawatan pengerusi SPR dan ahli SPR Sabah.

Mekanisme pelantikan ahli SPR, termasuk pengerusi, haruslah melalui jawatankuasa pilihan khas parlimen bagi memastikan proses pelantikan diselaraskan dengan prinsip-prinsip demokrasi, ketelusan dan berakauntabiliti.

Kaedah ini turut diguna pakai di negara-negara maju yang lain seperti di Kanada dan Australia yang melibatkan jawatankuasa khas atau badan bebas dalam pelantikan ahli-ahli suruhanjaya pilihan raya mereka. Pendekatan ini telah terbukti berkesan dalam menjamin kebebasan dan ketelusan dalam proses pelantikan tersebut.

Namun demikian, dengan memahami kesuntukan masa untuk melaksanakan proses tersebut, CSO Platform for Reform menggesa kerajaan melantik pakar pilihan raya sebagai pengerusi SPR, yang memiliki sifat reformis dan bebas bagi mengetuai suruhanjaya ini menuju proses persempadanan semula yang dijadualkan bermula dalam masa terdekat.

Pelantikan pengerusi SPR yang mempunyai kriteria ini adalah penting bagi memastikan tidak berlaku penyalahgunaan kuasa oleh kerajaan dalam sebuah institusi yang sepatutnya bebas dan terbuka seperti SPR.

Pengerusi SPR juga perlu merancakkan agenda reformasi pilihanraya, yang tergendala sejak tahun 2020. Beberapa isu penting yang perlu diberi perhatian serius, termasuklah keperluan bagi kaedah baharu untuk pengundi luar kawasan, pindaan pada Akta Kesalahan Pilihan Raya untuk menjadikannya lebih berkesan, dan perlaksanaan audit perbelanjaan raya oleh calon dan parti politik.

Tuntutan CSO Platform for Reform kepada kerajaan:

  • Lantiklah pengerusi SPR yang memiliki kepakaran sistem pilihan raya, reformis dan bebas
  • Pastikan agenda pembaharuan institusi dilaksanakan dalam proses pelantikan ahli-ahli SPR, terutamanya dalam perlantikan pengerusi yang akan datang, melalui kaedah yang telus, terbuka dan inklusif melalui jawatankuasa pilihan khas parlimen
  • Pastikan proses persempadanan semula kawasan pilihan raya dilaksanakan secara telus, terbuka dan inklusif supaya mengelakkan penyalahgunaan kuasa oleh pihak kerajaan
  • Pastikan agenda pembaharuan pilihan raya lain turut dilaksanakan seperti keperluan bagi kaedah baharu untuk pengundi luar kawasan, pindaan pada Akta Kesalahan Pilihan Raya, dan perlaksanaan audit perbelanjaan raya oleh calon dan parti politik

Appoint a reformist and independent Election Commission chairperson

CSO Platform for Reform voices our concern in the process of appointing the next chairperson of the Election Commission when Ghani Salleh, who is scheduled to retire compulsorily in May, together with filling a vacancy for the position of Sabah electoral commissioner.

The appointment of an election expert, reformist and independent chairperson of the Election Commission is important because he will be responsible for the process of redrawing constituency boundaries in Sarawak (ongoing), Sabah (2025) and the peninsula (2026), which is an important aspect of shaping the landscape of national democracy.

CSO Platform for Reform is consistent with our position that the “Madani” (civil and compassionate) government should implement a transparent, open, and inclusive election to fill the vacancy of Election Commission chairperson and Sabah electoral commissioner.

The appointment mechanism of electoral commissioners, including the chairperson, must go through a parliamentary special select committee to ensure that the appointment process is aligned with the principles of democracy, transparency and accountability.

This method is also used in other developed countries such as Canada and Australia, which involve special committees or independent bodies in the appointment of their electoral commissioners. This approach has proven to be effective in guaranteeing independence and transparency in the appointments process.

However, in understanding the lack of time to implement the process, CSO Platform for Reform urges the government to appoint an electoral expert as chairperson of the Election Commission – someone who has a reformist and independent nature to lead the commission towards the process of redrawing constituency boundaries, which is scheduled to begin soon.

The appointment of an Election Commission chairperson who has these criteria is important to ensure that there is no abuse of power by the government in an institution that should be free and open like the commission.

The chairperson also needs to speed up the electoral reform agenda, which has been stalled since 2020. Some important issues that need serious attention include the need for a new method for out-of-district voters, amendments to the Election Offences Act to make it more effective, and the implementation of election expenditure audits. by candidates and political parties.

CSO Platform for Reform demands that the government:

  • Appoint an Election Commission chairperson who is an electoral expert, reformist and independent
  • Ensure that the institutional reform agenda is implemented in the process of appointing electoral commissioners, especially in the appointment of the upcoming chairperson, through a transparent, open, and inclusive method through a parliamentary special select committee
  • Ensure that the redrawing of electoral areas is carried out in a transparent, open and inclusive manner to avoid abuse of power by the government
  • Ensure that other electoral reforms are also implemented such as the need for new methods for out-of-district voters, amendments to the Election Offences Act, and implementing election expenditure audits by candidates and political parties
