LFL tuntut empat beradik diberikan kerakyatan (Malay/English)

[ENGLISH VERSION BELOW] Aziq Fadyan, 24, Azreen Batrisya, 22, Azzahra Batrisya, 12, dan Azalea Batrisya, 9, telah dinafikan kewarganegaraan Malaysia secara tidak sah oleh kerajaan, menyebabkan mereka kini menjadi individu-individu tanpa kerakyatan (stateless).

Keempat-empat mereka dilahirkan di Malaysia. Bapa mereka adalah seorang warganegara Malaysia, Fadil Saharudin. Ibu mereka pula merupakan seorang warganegara Indonesia. Perkahwinan kedua ibu bapa mereka telah dilangsungkan di Indonesia serta Malaysia pada tahun 1998 sebelum kelahiran keempat-empat anak-anak muda tersebut.

Mereka berhak untuk mendapat taraf kewarganegaraan Malaysia di bawah Artikel 14(1)(b) dan Bahagian II Jadual Kedua Seksyen 1(a) dan 1(e) Perlembagaan Persekutuan. Dilahirkan dan dibesarkan di Malaysia, oleh seorang bapa yang mempunyai kewarganegaraan Malaysia, mereka bukan warganegara mana-mana negara lain kecuali Malaysia dan oleh itu mereka berhak mendapat kewarganegaraan Malaysia menurut Seksyen 1(a) dan 1(e) di Bahagian II Jadual Kedua Perlembagaan Persekutuan tersebut.

Akibat oleh penafian kerajaan Malaysia untuk mengiktiraf hak kewarganegaraan mereka, mereka telah dinafikan daripada mendapat pendidikan, pekerjaan dan perkhidmatan kesihatan yang sewajarnya. Mereka tidak dapat melakukan perkara-perkara asas seperti membuka akaun bank, mendapatkan lesen memandu mahupun mendapatkan pekerjaan yang sesuai dengan gaji yang berpatutan.

Kerajaan ini bertanggungjawab sepenuhnya ke atas segala diskriminasi, penghinaan dan penderitaan anak-anak muda yang hidup tanpa kerakyatan ini. Walaupun ini bukan salah anak-anak muda ini, kerajaan telah secara tidak munasabah dan dengan zalimnya telah menyebabkan mereka mengharungi kehidupan yang teruk yang dialami oleh orang-orang tanpa kerakyatan (stateless).

Kami menggesa menteri dalam negeri dan kabinet untuk campur tangan dalam perkara ini dengan segera, serta memastikan anak-anak muda ini ini diiktiraf sebagai warganegara Malaysia serta merta. Kami seterusnya menggesa agar kerajaan dan menteri pendidikan memastikan adik-adik Azzahra dan Azalea, yang masing-masing berumur 12 dan 9 dimasukkan dengan segera ke dalam sekolah kebangsaan yang sesuai.

Kes Aziq, Azreen, Azzahra dan Azalea hanyalah sebahagian kecil daripada apa yang dialami oleh negara ini. Terdapat puluhan ribu kes yang serupa di Malaysia, kanak-kanak mengalami kehidupan yang sengsara dan musnah walaupun mereka sesungguhnya berhak mendapat kewarganegaraan Malaysia mengikut kuatkuasa undang-undang.

Kami menggesa kerajaan untuk segera meneliti semua kes-kes ini dan memberikan kewarganegaraan kepada sesiapa yang layak di bawah Perlembagaan yang mana telah dilucutkan kewarganegaraan secara tidak sah dan menyalahi undang-undang sehingga kini.

Government must immediately acknowledge Malaysian citizenship of family of four young stateless siblings

Aziq Fadyan, 24, Azreen Batrisya, 22, Azzahra Batrisya, 12, and Azalea Batrisya, 9, have been unlawfully denied Malaysian citizenship by the government and are now stateless persons.

All four of them were born in Malaysia. Their father was a Malaysian citizen, Fadil Saharudin. Their mother is an Indonesian. Their marriage was solemnised in Indonesia and Malaysia in 1998 prior to the birth of the four children.

They are entitled as of right to Malaysian citizenship under Article 14(1)(b) and Part II Second Schedule, Section 1(a) and 1(e) of the Federal Constitution. Born and raised in Malaysia by a Malaysian father, they are citizens of no other country but Malaysia and they are entitled to Malaysian citizenship by virtue of Section 1(a) and 1(e).

As a result of the refusal of the Malaysian government to acknowledge their rights to citizenship, they have been denied a proper education, employment and healthcare. They cannot do the most basic things like opening a bank account or getting a driving licence or getting a proper job for a fair salary.

The government bears total responsibility for the discrimination, humiliation and suffering of these young stateless Malaysians. Though they are faultless, the government has unreasonably and cruelly made them endure the terrible life that stateless persons are subjected to.

We urge the home minister and cabinet to intervene in their matter immediately and urgently ensure that these Malaysian children are acknowledged as Malaysian citizens. We further urge the government and education minister to ensure the immediate entry into a suitable government school for Azzahra and Azalea, who are 12 and 9 respectively.

The case of Aziq, Azreen, Azzahra and Azalea is just the tip of the iceberg. There are tens of thousands of similar cases in Malaysia, children suffering and their lives ruined although entitled to Malaysian citizenship by law.

We urge the government to immediately look into all these cases and grant citizenship to all who are qualified under the Constitution but have been unlawfully deprived of citizenship to date.
