Majlis Peguam menyokong YDP Badan Peguam dan kenyataan medianya mengenai penyalahgunaan proses (Malay/English)

[ENGLISH VERSION BELOW] Majlis Peguam Malaysia, pada mesyuarat yang diadakan pada 3 September, telah dengan sebulat suara menyatakan sokongannya terhadap yang dipertua Badan Peguam Malaysia, Karen Cheah Yee Lynn, dan berpegang teguh dengan kenyataan media bertajuk “Penyalahgunaan proses mencemarkan sistem keadilan kita” yang dikeluarkannya pada 19 Ogos.

Kenyataan media tersebut dibuat bagi pihak Badan Peguam Malaysia berkenaan dengan kes yang melibatkan bekas perdana menteri di Mahkamah Persekutuan baru-baru ini, dan merupakan hal perkara di dalam surat tuntutan bertarikh 26 Ogos yang dikeluarkan oleh Tetuan Zaid Ibrahim Suflan TH Liew & Partners yang mewakili tiga orang rakan kongsi mereka, Zaid Ibrahim, Liew Teck Huat dan Rueben Mathiavaranam.

Badan Peguam Malaysia melalui surat bertarikh 2 September yang dikeluarkan oleh peguamnya telah menjawab surat tuntutan tersebut dan menafikan dakwaan-dakwaan yang dibuat.

Badan Peguam Malaysia sentiasa menyuarakan dan akan terus menyuarakan kebimbangannya berkenaan dengan perkara yang melibatkan kepentingan awam – pentadbiran keadilan dan standard profesion undang-undang negara kita. Serangan terhadap Yang Dipertua Badan Peguam Malaysia yang melaksanakan tanggungjawab yang dinyatakan adalah satu serangan ke atas Majlis Peguam, dan juga serangan ke atas Badan Peguam Malaysia.

Badan Peguam Malaysia akan meneruskan tugas dan usahanya tanpa gentar atau berat sebelah dan tidak akan tunduk kepada sebarang intimidasi.

Bar Council unanimously stands by Bar president and her press release on abuse of process

The Bar Council, at its meeting on 3 September, unanimously expressed its support for the president of the Malaysian Bar, Karen Cheah Yee Lynn, and stands by her press release entitled “Abuse of process brings disrepute to our justice system” issued on 19 August.

The press release was made on behalf of the Malaysian Bar in relation to the recent case involving the former prime minister at the Federal Court, and is the subject matter of a letter of demand dated 26 August issued by Messrs Zaid Ibrahim Suflan TH Liew & Partners representing three of their partners, Zaid Ibrahim, Liew Teck Huat and Rueben Mathiavaranam.

The Malaysian Bar has, by a letter dated 2 September issued by its legal counsel, replied to the letter of demand denying the allegations.

The Malaysian Bar has always expressed and will continue to express its concerns on matters of public interest – the administration of justice, and the standards of the legal profession in the country. An attack on the president of the Malaysian Bar for doing so, is an attack on the Bar Council, and by extension, an attack on the Malaysian Bar.

The Malaysian Bar will continue its duty and efforts uninfluenced by fear or favour, and will not cower from any act of intimidation.
