Peraturan mesyuarat Dewan Rakyat perlu diperkasa demi perundangan yang bebas, profesional dan berkesan (Malay/English)

[ENGLISH VERSION BELOW] Kaukus Parlimen Demokrasi Pelbagai Parti menggesa peraturan mesyuarat Dewan Rakyat diperkasa dan ditambahbaik.

Adalah penting supaya pindaan dibuat kepada Peraturan Mesyuarat, memandangkan kelemahan peraturan dan proses Parlimen semasa yang telah melemahkan peranan Parlimen sebagai cabang perundangan yang bebas, profesional dan berkesan.

Kaukus dengan sukacitanya melancarkan laporan penyelidikan yang dinaungi oleh Gabungan Pilihan Raya Bersih dan Adil (Bersih), bertajuk “Unlocking the Power of the Dewan Rakyat: The Rule Revisions Needed Now“, yang ditulis oleh pakar parlimen, Maha Balakrishnan.

Reformasi peraturan mesyuarat telah dijanjikan dalam Memorandum Persefahaman (MoU) transformasi dan kestabilan politik antara kerajaan dan Pakatan Harapan namun masih belum ditunaikan.

Oleh itu, kami menggesa pemain politik dalam proses ini, khususnya kerajaan dan Dewan Rakyat supaya menyegerakan proses pindaan peraturan mesyuarat sebelum Parlimen dibubarkan.

Berikut adalah cadangan pembaharuan seperti yang terkandung dalam kertas kajian ini:

  • Pengurusan usul percaya dan tidak percaya
  • Kawalan masa dan agenda parlimen dengan mengurangkan kawalan kerajaan ke atas kalendar parlimen, mengiktiraf kehendak majoriti parlimen (parliamentary majority) dan meningkatkan kepastian dan konsistensi untuk menyelesaikan urusan dewan
  • Menambahbaik struktur peluang untuk urusan ahli persendirian (private members’ business) dengan mewujudkan slot mingguan khusus untuk urusan ahli persendirian, memastikan pelaksanaan urusan yang adil dan saksama ketika masa ahli persendirian (private members’ time), mengurangkan sekatan ke atas usul ahli persendirian (private members’ motions) dan memudahkan proses rang undang-undang ahli persendirian (private members’ bills) dan membebaskannya daripada kawalan kerajaan
  • Membolehkan orang ramai membuat petisyen kepada Parlimen dengan merombak proses petisyen parlimen di Dewan Rakyat, mewujudkan kedua-dua jenis sistem petisyen kertas dan e-petisyen, mewujudkan mekanisme maklum balas wajib dan menubuhkan sebuah jawatankuasa petisyen tetap yang baharu
  • Meningkatkan keupayaan jawatankuasa-jawatankuasa parlimen untuk beroperasi secara bebas untuk agenda jawatankuasa, kuasa untuk mengadakan pendengaran dan cara menerbitkan penyata mereka sendiri, dan pengeluaran garis panduan untuk pemegang taruh seperti kuasa, kewajiban dan perlindungan saksi serta proses inkuiri

Kaukus akan mengkaji dengan teliti cadangan yang dibuat oleh Bersih dalam laporan ini dan jika terdapat kata sepakat di kalangan ahli kami, kami akan berusaha untuk melakukan libat urus dengan Jawatankuasa Peraturan Mesyuarat, Jawatankuasa Dewan, pejabat Yang di-Pertua dan para pengerusi jawatankuasa pilihan lain, untuk pelaksanaan beberapa cadangan ini.

Sementara itu, kami mengucapkan tahniah kepada Bersih dan Maha Balakrishnan atas sebuah laporan kajian yang cemerlang yang mana cadangannya, jika diterima pakai, akan membuka kunci kepada Dewan Rakyat untuk memenuhi peranan perlembagaannya sebagai cabang perundangan Kerajaan. – Kaukus Parlimen

Unlocking the power of the House through standing orders reform

The Parliamentary Caucus for Multi-Party Democracy calls for the standing orders of the House of Representatives to be empowered and enhanced.

It is critical that amendments are made to the standing orders, given the weakness of current rules, regulations and the parliamentary process that has weakened the role of Parliament as an independent, professional and effective legislative branch of government.

The caucus is happy to launch a research report commissioned by the Coalition for Clean and Fair Elections (Bersih) entitled “Unlocking the Power of the Dewan Rakyat: The Rule Revisions Needed Now“, authored by parliamentary expert Maha Balakrishnan.

Reforms to the standing orders were promised in the Memorandum of Understanding (MoU) on transformation and political stability between the government and Pakatan Harapan but yet unfulfilled. Therefore, we urge the political actors in the process, in particular the government and the House of Representatives, to hasten the process of amending the standing orders before Parliament is dissolved.

The following are the proposed reforms, as contained in this research paper:

  • Management of motions of confidence and no confidence
  • Control of parliamentary time and agenda by reducing government control over the parliamentary calendar, recognising the will of the parliamentary majority and improving certainty and consistency to complete the business of the House
  • Improving opportunity structures for private members’ business by creating specific weekly slots for such business, ensuring fair and equitable disposal of business during private members’ time, reducing restrictions on private members’ motions and simplifying the process of private members’ bills and detaching it from government control
  • Enabling the public to petition Parliament by overhauling the parliamentary petitions process in the House of Representatives, setting up both paper petition and e-petition systems, establishing an obligatory response mechanism and establishing a new standing petitions committee
  • Improving the ability of parliamentary committees to operate independently for the committees’ agendas, the power on holding their hearings and how to publish reports, and issuance of guidelines for stakeholders such as powers, witnesses’ obligations and protections and the inquiry process

The caucus will be closely studying the proposals made by Bersih in this report and, where there is consensus among our members, we will seek to engage with the Standing Orders Committee, the House Committee, the Speaker’s office and other heads of select committees for the implementation of some of these proposals. – Parliamentary Caucus

Meanwhile, we congratulate Bersih and Maha Balakrishnan for a well-researched report whose proposals, if adopted, would go a long way to unlock the House of Representatives to fulfil its constitutional role as the legislative branch of government.
