Bila pengundi luar kawasan boleh undi pos? (Malay/English)

[ENGLISH VERSION BELOW] Gabungan Pilihan Raya Bersih dan Adil (Bersih 2.0) menggesa Suruhanjaya Pilihan Raya (SPR) untuk menyatakan kesanggupan secara umum bila pengundi luar kawasan boleh mengundi secara pos. Adakah perkara ini akan terlaksana untuk pilihan raya negeri Sarawak dan pilihan raya umum yang akan datang?

Bersih 2.0 merujuk kepada kenyataan SPR pada 15 Ogos 2020 bahawa tidak ada undi pos bagi orang Sabah yang tinggal di Semenanjung atau Sarawak untuk pilihan raya negeri Sabah kelak.

Bersih Sabah telah mengeluarkan kenyataan dan memulakan petisyen sokongan pada 2 Ogos menggesa agar kemudahan tersebut dipanjang kepada orang Sabah yang tinggal di luar Sabah.

Bersih 2.0 kecewa bahawa SPR masih tidak dapat melaksanakan reformasi prosedur ini walaupun ianya pernah dicadangkan oleh Jawatankuasa Pilihan Khas Parlimen yang diketuai oleh Maximus Ongkili pada 2012. Undi pos dicadangkan untuk diberikan kepada orang Sabah, Sarawak dan Semenanjung Malaysia yang berada di luar kawasan mereka semasa pilihan raya.

Kami menggesa SPR mewartakan pengundi luar kawasan sebagai pengundi awal yang layak untuk undi pos di bawah Peraturan-Peraturan Pilihan Raya 2012 (Undi Awal) Seksyen 3(1)(e) untuk mengimplementasi proses tersebut.

Semasa pilihan raya umum 2018, seramai 51,472 pegawai daripada Jabatan Penyelamat, Jabatan Imigresen, hospital dan klinik, Angkatan Penguatkuasaan Maritim Malaysia, Jabatan Pertahanan Awam dan Agensi Pengurusan Bencana Kebangsaan (Nadma) telah memohon untuk hak mengundi secara pos di bawah peruntukan ini.

Bersih 2.0 ingin mengingatkan SPR bahawa ianya adalah tanggungjawab mereka untuk memastikan pengundian semudah mungkin bagi pengundi membuang undi, dan sebarang kesukaran yang dikenakan kepada pengundi secara langsung atau tidak langsung melalui peraturan yang tidak perlu atau tidak adanya kemudahan boleh dianggap sebagai halangan kepada hak pengundi.

Ramai rakyat Malaysia, termasuk orang Sabah dan Sarawak, terpaksa mencari kerja yang jauh daripada kawasan mereka disebabkan pembangunan ekonomi yang tidak serata antara negeri dan mereka tidak sepatutnya dibebani secara kewangan atau diletakkan dalam risiko semasa pandemik Covid-19 ini dengan perjalanan pulang ke kawasan masing-masing hanya untuk melaksanakan hak asasi mereka untuk mengundi.

Kami menganggarkan hampir 20% pengundi Malaysia Timur yang tinggal dan bekerja di Semenanjung Malaysia serta ramai orang Semenanjung yang tinggal dan bekerja di Malaysia Timur.

Kami menggesa agar SPR dapat mempercepatkan proses pengundian pos atau apa saja cara lain bagi membolehkan rakyat Malaysia yang mahu mengundi berbuat demikian tanpa ada kesulitan.

SPR perlu menetapkan tarikh untuk proses tersebut siap, dan harapannya agar sempat untuk pilihan raya negeri Sarawak yang akan berlaku bila-bila masa sebelum September 2021.

Sebarang proses atau kemudahan bagi undi pos atau undi tidak hadir mesti terbukti tahan lasak, telus, adil dan mudah kepada pengundi yang layak. Ianya juga mesti mendapat keyakinan daripada pengundi dan calon bahawa undi tersebut adalah suara sebenar mereka yang mengundi.

Bersih 2.0 mengambil maklum bahawa satu jawatankuasa khas SPR untuk menambahbaik proses undi pos dan untuk mengkaji alternatif yang lain telah ditubuhkan.

Jawatankuasa tersebut perlu melibatkan pelbagai pemegang taruh untuk mencadangkan sebarang perubahan, dan kami lebih daripada sanggup untuk memberikan pandangan sekiranya diperlukan.

When can out-of-region voters use postal voting?

The Coalition for Clean and Fair Elections (Bersih 2.0) calls upon the Election Commission to commit publicly to when out-of-region voters can vote using postal votes.

Will that happen for the Sarawak state election and the next general election?

Bersih 2.0 refers to statement issued by the Election Commission on 15 August 2020 that there will be no postal voting for Sabahans residing in the peninsula or Sarawak in the coming Sabah state slection.

Sabah Bersih had issued a statement and started a petition drive (2) on 2 August urging that such a facility be extended to Sabahans residing outside Sabah.

Bersih 2.0 is disappointed that the Election Commission is still unable to deliver on this procedural reform despite it being one of the recommendations made by the special parliamentary select committee led by Maximus Ongkili in 2012. It was recommended that postal votes be given to Sabahans, Sarawakians and West Malaysians who are away from their own region during elections.

We suggest the Election Commission gazette out-of-region voters as advance voters eligible for postal voting under Regulation 3(1)(e) of the Elections (Advance Voting) Regulations 2012 in order to implement such a process.

In the 2018 general election, as many as 51,472 persons from Fire and Rescue Department, Immigration Department, hospitals and clinics, Maritime Enforcement Agency, Civil Defence Department and National Disaster Management Agency (Nadma) applied for such postal voting rights under this provision.

Bersih 2.0 wishes to remind the Election Commission that it is its duty to make it as convenient as possible for voters to cast their votes, and any inconveniences imposed on voters either directly or indirectly through unnecessary regulations or the non-availability of facilities can be construed as suppression of voters’ rights.

Many Malaysians, including Sabahans and Sarawakians, are compelled to find jobs far from their regions due to unequal economic development among the states, and they should not be further burdened financially or put at risk during this Covid-19 pandemic, by travelling back to their constituencies just to exercise their fundamental right to vote. We estimate that up to 20% of eligible East Malaysian voters live and work in West Malaysia and a good number of West Malaysians do likewise in East Malaysia.

We call on the Election Commission to expedite the process for postal voting or any other means to enable Malaysians who want to vote to do so without much inconvenience. The commission should set a deadline for such a process to be ready, and hopefully it will be in time for the Sarawak state election, which has to be called anytime before September 2021.

Any postal or absent voting process or facilities must be tamper-proof, transparent, fair and convenient to eligible voters. It should also inspire confidence among voters and candidates that the votes are a true expression of those who cast these votes.

Bersih 2.0 is glad to know that a special Election Commission committee was established to improve the postal voting process and to explore other alternatives. This committee should consult various stakeholders on any proposed changes, and we would be happy to give our input, if asked.
