Hari Malaysia tak bermakna tanpa kedaulatan undang-undang dan kerajaan bersih (Malay/English)

[ENGLISH VERSION BELOW] Dalam kita menyambut Hari Malaysia ke-60, jangan kita lupakan bahawa kemerdekaan adalah usahan yang berterusan dan tidak akan pernah selesai.

Kemerdekaan bukan sahaja tentang soal menghalau penjajah, tetapi berkisar rakyat menjadi tuan kepada kerajaan mereka dan menentukan nasib sendiri.

Kita boleh dijajah oleh orang sendiri jika demokrasi dibungkam dan dijajah oleh pihak asing sekiranya kerajaan kita menjual diri kepada kuasa luar.

Maka, kemerdekaan memerlukan kedaulatan undang-undang, di mana semua orang termasuklah ketua kerajaan adalah setara di hadapan undang-undang, serta kerajaan yang bersih di mana wang rakyat tidak boleh dirompak dan kuasa tidak boleh dijual beli.

Kemerdekaan kita di titik paling lemah pada 27 Julai 2015 apabila Perdana Menteri Najib Razak memecat peguam negara [pada masai itu] Gani Patail dan menggantikannya dengan Apandi Ali untuk mengelakkan beliau sendiri didakwa dengan skandal 1MDB. Hakikatnya ketika itu, Najib tidak tertakluk kepada undang-undang di Malaysia.

Pilihan raya umum 2018 yang membolehkan Najib dan rakan subahat beliau didakwa menjadi titik perubahan kepada bukan sahaja demokrasi negara, tetapi juga kepada kemerdekaan dan kedaulatan undang-undang kita.

Peralihan secara demokrasi adalah buah kepada darah, peluh dan air mata yang dititiskan oleh generasi-generasi rakyat Malaysia yang menuntut demokrasi yang sebenar. Ramai hilang kebebasan, sementara ramai lagi yang menderita akibat keganasan pihak polis hanya kerana melaksanakan hak mereka untuk bersuara dan berhimpun secara aman.

Apa sahaja kecenderungan dan kepentingan parti kita, berakhirnya pemerintahan satu parti dan kejatuhan Najib perlu diraikan kerana Malaysia dapat bergerak ke arah demokrasi pelbagai parti dan memulihkan semula kedaulatan undang-undang.

Kemerdekaan di Malaysia kembali di puncak apabila pada 23 Ogos 2022 dengan Najib disabitkan bersalah dan dipenjarakan. Mesej jelas dihantar kepada semua rakyat Malaysia, bahkan perdana menteri tidak berada di atas undang-undang, dan jika melakukan jenayah anda akan dihukum.

Kami mengalu-alukan pengumuman Menteri Undang-Undang dan Reformasi Institusi Azalina Othman Said yang melantik dua pasukan petugas khas untuk kajian perbandingan antara negara dan kajian teknikal berkenaan pemisahan pendakwa raya dan peguam negara dalam tempoh setahun. Kami berpandangan bahawa pemisahan ini perlu disiapkan dalam tempoh setahun, dan tidak boleh ditangguhkan atas alasan teknikal atau kewangan.

Kami ingin menegaskan bahawa sementara proses pemisahan pendawa raya dan peguam negara dalam setahun ini berjalan, “kerajaan perpaduan” dan peguam negara perlu membuat jaminan terbuka atas perkara-perkara berikut:

  • Moratorium permohonan DNAA [tertuduh dilepaskan tanpa dibebaskan] kes-kes berprofil tinggi melibatkan ahli politik seperti kes Najib yang sedang berjalan, kes Rosmah Mansor yang sedang berjalan, kes Lim Guan Eng, kes Syed Saddiq Syed Abdul Rahman dan sebagainya. Biarlah pihak kehakiman menentukan sama ada mereka bersalah atau tidak, tanpa campur tangan AG atau tuan politik beliau
  • Mendakwa semula Zahid sesegera mungkin selepas siasatan baharu terhadap kes Yayasan Akalbudi – satu yayasan untuk membantu masjid, pusat tahfiz dan anak-anak yatim – yang melibatkan 47 dakwaan korupsi, pecah amanah dan penggubahan wang haram
  • Memastikan rayuan Jabatan Peguam Negara terhadap kes sistem visa luar negara (VLN) Zahid yang melibatkan 40 dakwaan rasuah tidak akan terhenti secara tiba-tiba kerana sesetengah perkara teknikal
  • Menyiasat kegagalan pendakwa raya dalam mematuhi tarikh permohonan rayuan terhadap Najib dan bekas ketua pengarah 1MDB Arul Kanda Kandasamy dalam kes penggubahan laporan audit 1MDB yang mengakibatkan pembebasan mereka dan menghukum kelaihan pegawai Jabatan Peguam Negara yang bertanggungjawab

Hakikatnya kredibiliti Jabatan Peguam Negara telah terhakis teruk dengan siri keputusan untuk memohon tertuduh dilepaskan tanpa dibebaskan atau dilepaskan dan dibebaskan, untuk ramai ahli politik dan pegawai kerajaan daripada mantan menteri kewangan Lim Guan Eng kepada mantan ketua menteri Sabah Musa Aman. Perdana menteri yang menyetujui keputusan ini jelas menyokong pembebasan secara terpilih.

Sekiranya Najib dipenjarakan tahun lepas kerana beliau sudah tidak lagi berkuasa namun berjalan bebas esok kerana parti beliau berkuasa semula, maka mesej kepada rakyat Malaysia adalah sangat jelas: kamu tidak bersalah sehinggalah kamu hilang kuasa, dan kamu menjadi suci semula selepas kamu berkuasa semula. Hal ini akan memusnahkan keyakinan rakyat kepada sistem politik kita dan menyebabkan kesinisan politik yang melampau.

Akibatnya adalah maha hebat: mana-mana penjenayah yang ingin bebaskan diri hanya perlu memenangi pilihan raya umum dan kemudiannya tukar sahaja peguam negara. Malaysia sebegini, di mana salah atau tidak bersalah bergantung kepada kuasa dan pilihan raya menggantikan mahkamah untuk menghakimi keadilan, akan menjadi negara pariah dan sasaran utama untuk penjajahan ekonomi.

Pada Hari Malaysia ke-60 ini, kami memohon kewarasan dan nurani semua parti politik dan wakil rakyat untuk mempertahankan kemerdekaan dengan menegakkan kedaulatan undang-undang dan kerajaan yang bersih. Kami menggemakan semula seruan kami supaya terjalinnya perjanjian damai antara parti untuk mencegah sebarang ugutan politik daripada rakan kongsi kerajaan campuran.

Najib yang merompak negara perlu kekal di dalam penjara untuk kes SRC beliau dan dibicarakan seadilnya bagi kes yang berbaki lagi. Sekiranya garis merah ini dilanggar, rakyat Malaysia harus siap sedia untuk melangkah ke jalan raya sekali lagi untuk mempertahankan Malaysia. – Bersih

Malaysia Day is meaningless without the rule of law and a clean government

As we celebrate Malaysia’s 60th birthday, let us remember independence is always a work in progress, never a finished business.

Independence is not about merely getting rid of foreign rulers, but about people being the boss of their government and master of their own destiny.

We can be recolonised internally when our democracy is disabled and externally when our government sell out to foreign powers.

Hence, independence requires the rule of law, where everyone including the head of government is equal before the law, and a clean government, where public funds cannot be plundered, and power cannot be bought.

Our nation’s independence was at its weakest point on 27 July 2015 when Prime Minister Najib Razak sacked the then attorney general, Gani Patail, and appointed Apandi Ali as his replacement to prevent his own prosecution over the 1MDB scandal. Najib was effectively above the law in Malaysia

The 2018 general election that enabled Najib and his partners in crime to be charged was a turning point not only for our democracy but also our independence and the rule of law.

The democratic transition was the fruit of the blood, toil, tears and sweat by generations of Malaysians in demanding true democracy. Many lost their freedom while many more suffered police violence for exercising their constitutional right to speech and peaceful assembly.

Whatever our partisan preference and interests are, the end of one-party rule and the ouster of Najib should be cherished because it allowed Malaysia to move towards a multi-party democracy and revive the rule of law.

Malaysia’s independence returned to its highest point on 23 August 2022 with the conviction and imprisonment of Najib. It sent a clear message to every Malaysian: even the prime minister is not above the law; commit a crime and you will be punished.

We warmly welcome Law and Institutional Reform Minister Azalina Othman Said’s announcement of the appointing of two taskforces for cross-national and technical studies on the separation of the public prosecutor’s role from the attorney general’s within a year. We think that the separation should be completed within a year, and that should not be delayed on technical or financial grounds

We would like to make clear that while the separation of the attorney general and public prosecutor in a year’s time is being processed, the “unity government” and the attorney general must give a public assurance on the following:

  • To put in place a moratorium on applications for a “discharge not amounting to an acquittal” on high-profile cases involving politicians, namely Najib’s ongoing and outstanding cases, his wife Rosmah Mansor’s ongoing cases, Lim Guan Eng’s, Syed Saddiq Syed Abdul Rahman and any other cases. Let the judiciary determine their guilt or innocence without any interference from the attorney general or his political master
  • To recharge Zahid again as soon as possible after a new investigation into the case of Yayasan Akalbudi – a charity foundation purportedly for mosques, tahfiz and orphans – which carried 47 charges of corruption, criminal breach of trust and money laundering
  • To ensure the Attorney General’s Chambers’ appeal on Zahid’s foreign visa system (VLC) case which carried 40 charges of bribery would not be thrown out conveniently on some technical grounds
  • To investigate the prosecution’s failure in missing the deadline to file an appeal against Najib and former 1MDB president Arul Kanda Kandasamy in the 1MDB audit report tampering case, resulting in their acquittal, and to duly punish the negligence of the Attorney General’s Chambers’ officials responsible

The truth of the matter is that the Attorney General’s Chambers’ credibility has been greatly tarnished by its serial decisions to apply for a discharge not amount to acuittal or a discharge amounting to an acquittal for so many government politicians and officials from the then finance minister Lim Guan Eng to former Sabah chief minister Musa Aman. A prime minister who endorses such a decision is simply endorsing selective impunity.

If Najib was jailed last year because he was out of power but walks free tomorrow because his party is back to power, then the message to the people is loud and clear: you are innocent until you lose power, and you regain innocence when you regain power. It will destroy public confidence in our political system and produce political cynicism.

The implication would be disastrous: any criminal who wants to get away should just win the next general election and change the attorney general. Such a Malaysia, where innocence hinges on power and an election replaces the court in deciding justice, would be an international pariah and a prime target for economic colonisation.

On Malaysia’s 60th birthday, we appeal to the common sense and decency of all political parties and elected representatives to defend our independence by upholding the rule of law and a clean government. We renew our call for an inter-party peace deal to prevent any political blackmail from partners in a coalition government.

Najib who looted Malaysia must remain in jail for his SRC case and be tried fairly for the remaining cases. If this red line is breached, Malaysians must be ready to stand up and be counted on the streets to defend our beloved Malaysia. – Bersih
