[ENGLISH VERSION BELOW] Gabungan Pilihan Raya Bersih dan Adil (Bersih 2.0) mengalukan keputusan Mahkamah Pilihan Raya yang mengisytiharkan agar kerusi parlimen Cameron Highland dikosongkan selepas amalan rasuah semasa pilihan raya umum 2018 yang lalu berjaya dibuktikan berlaku dengan pengetahuan dan kebenaran oleh calon BN C Sivarraajh.
Kami juga memuji Suruhanjaya Pencegahan Rasuah Malaysia yang memulakan siasatan tuduhan rasuah semasa pilihan raya umum di kawasan Cameron Highland sebagaimana yang telah dilaporkan oleh akhbar New Straits Times pada 2 Disember 2018.
Oleh kerana rasuah telah dibuktikan di Mahkamah Pilihan Raya, bahawa sejumlah wang telah diberikan kepada pengundi oleh C Sivarraajh dan Menteri Besar Pahang Wan Rosdy Wan Ismail, kami menggesa agar hukuman dibawah Seksyen 10 Akta Kesalahan Pilihan Raya dijatuhkan kepada C Sivarraajh, Wan Rosdy Wan Ismail dan sesiapa sahaja yang terlibat dalam merasuah pengundi.
Sesiapa yang terlibat dalam kesalahan rasuah boleh disabitkan hukuman penjara selama dua tahun, denda sehingga RM5,000 serta tidak boleh memilih dan dipilih di dalam pilihan raya selama lima tahun. Untuk Wan Rosdy, kerusinya juga harus dikosongkan atas kesalahan yang sama.
Semoga kes ini menjadi satu peringatan kepada semua parti politik serta calon pilihan raya yang akan datang bahawa kesalahan pilihan raya tidak boleh diambil mudah dan sesiapa yang disabitkan kesalahan tidak kira daripada parti pemerintah mahupun parti pembangkang, akan dihukum oleh undang-undang bagi mempertahankan integriti pilihan raya.

Prosecute BN candidate for Cameron Highlands and Pahang MB for bribery
The Coalition for Clean and Fair Elections (Bersih 2.0) welcomes the Election Court ruling that declared the Cameron Highlands parliament seat vacant after corrupt practices were proven to have been committed with the knowledge and consent of the BN candidate C Sivarraajh in the 2018 general election.
We also commend the Malaysian Anti-Corruption Commission for beginning the investigations into allegations of corruption during the general election in the Cameron Highlands constituency, as reported by New Straits Times on 2 December 2018.
As bribery was proven in the Election Court, in that money was given to voters by C Sivarraajh and current Pahang Menteri Besar Wan Rosdy Wan Ismail, we call for the prosecution of Sivarraajh, Wan Rosdy and anyone involved in bribing voters under Section 10 of the Election Offences Act.
Those found guilty of the offence of bribery shall be liable to imprisonment for up to two years, a fine of up to RM5,000 and the removal of the right to vote and be elected in election for five years. As for Wan Rosdy, his seat shall be vacated upon conviction, too.
May this case serve as a timely reminder to all political parties and future election candidates that electoral offences will not be condoned and those implicated whether they are from the ruling or opposition parties, must be punished under the law to uphold the integrity of the elections.
