Jawatankuasa pilihan khas parlimen perlu diperkasa (Malay/English)

[ENGLISH VERSION BELOW] Gabungan untuk Pilihan Raya Bersih dan Adil (Bersih 2.0) menggesa agar fungsi, kuasa, sumber dan kebebasan jawatankuasa pilihan khas parlimen diperkasa serta diberi perhatian serius selaku instrumen semak dan imbak peringkat persekutuan kepada kerajaan dan agensi di bawahnya.

Perkara ini juga termasuk dalam usaha bagi mengangkat doktrin pemisahan kuasa antara badan eksekutif dan badan perundangan signifikan dalam sebuah negara demokrasi yang sihat.

Bersih 2.0 telah melancarkan sebuah laporan kajian yang bertajuk “Reformasi Jawatankuasa Pilihan Parlimen”. Laporan ini dinaungi oleh Bersih 2.0 dan ditulis oleh Dr Muhammad Sayuti Hassan dan Sahanah Kathirvelu. Laporan kajian ini antara lain mengenalpasti keterpinggiran ahli parlimen pembangkang dan ahli parlimen penyokong kerajaan dalam proses pembuatan dasar dan undang-undang di Parlimen. Kuasa terlalu tertumpu kepada eksekutif, peluang menyumbang terhad dan kurang dilibatkan peranannya dalam jawatankuasa pilihan khas. Sebagai contoh, sembilan daripada 10 jawatankuasa pilihan khas dipengerusikan oleh ahli parlimen penyokong kerajaan.

Oleh itu, kami menggesa agar pihak pimpinan kerajaan baharu dan dan Parlimen Malaysia mengambil tanggungjawab dan komited terhadap reformasi insitusi Parlimen sekaligus memperkasa jawatankuasa pilihan khas ini. Berikut merupakan cadangan reformasi oleh Bersih 2.0 seperti terdapat dalam kertas kajian terbaru kami ini seperti:

  • Pindaan peraturan mesyuarat bagi mengembangkan kuasa jawatankuasa pilihan khas, menambahbaik proses pelantikan, diberi keanjalan bentuk mesyuarat, tanggungjawab eksekutif untuk memberi maklum balas kepada dapatan jawatankuasa pilihan khas, mengkaji semula komposisi ahli jawatankuasa pilihan khas serta siaran langsung aktiviti-aktiviti dilakukan jawatankuasa pilihan khas
  • Memperkasa peranan dan kuasa jawatankuasa pilihan khas untuk mendapatkan bahan bukti dan mengadakan inkuiri serta siasatannya sendiri
  • Menilai kembali tatacara pelantikan ahli jawatankuasa pilihan khas supaya ia seimbang dan berkadar dengan perwakilan keseluruhan di dalam Dewan. Juga dicadangkan agar ahli dipilih melalui proses pencalonan dan ahli dibenarkan memilih sendiri jawatankuasa pilihan khas mengikut minat serta kepakaran
  • Menginstitusikan blok pembangkang dengan mengiktiraf ketua pembangkang setaraf menteri kabinet
  • Mengadakan siaran langsung terhadap segala kerja jawatankuasa pilihan khas untuk tontonan awam bagi membina kepercayaan dan keyakinan awam terhadap institusi Parlimen
  • Memberi keanjalan kepada jawatankuasa pilihan khas untuk menentukan bentuk mesyuaratnya sendiri yang tidak terhad hanya di dalam premis Parlimen. Lebih-lebih hal ini mendesak ketika pandemik sekarang supaya diberi kemudahan diadakan mesyuarat secara mod maya mahupun hibrid
  • Meningkatkan bilangan jawatankuasa pilihan khas di kedua-dua Dewan Rakyat dan Dewan Negara berdasarkan keperluan tertentu serta mengisi kelompongan pemantauan terhadap kementerian-kementerian semasa yang tidak dipantau
  • Memperuntukkan peruntukan belanjawan secukupnya bagi menjamin fungsinya efisien dan operasinya lancar. Pengerusi jawatankuasa pilihan khas harus diberikan elaun berasingan di bawah Akta Ahli Parlimen (Saraan) 1980
  • Menyediakan tenaga kerja mencukupi dengan mengembangkan saiz urus setia jawatankuasa pilihan khas termasuk penyelidik, pakar, kerani dan staf sokongan. Sekurang-kurangnya diperuntukkan dua orang penyelidik bagi setiap jawatankuasa pilihan khas
  • Mengadakan latihan berterusan dan berkala kepada semua ahli parlimen dan urus setia jawatankuasa pilihan khas mengenai amalan terbaik dan perkembangan terbaru berkaitan institusi Parlimen

Parliamentary special select committees need to be empowered

The Coalition for Clean and Fair Elections (Bersih 2.0) calls for the functions, powers, resources and independence of the parliamentary special select committees to be empowered and given serious attention at the federal federal level so that they can act as an instrument of checks and balances on the government and its agencies.

This matter is also included in the effort to elevate the doctrine of separation of powers between the executive and the legislature significantly in a healthy democracy.

Bersih 2.0 recently launched a research report “Parliamentary Select Committee Reforms”. This report was commissioned by Bersih 2.0 and written by Dr Muhammad Sayuti Hassan and Sahanah Kathirvelu. This research report, among others, identifies the marginalisation of opposition and backbencher MPs in the policy and law-making process in Parliament. Power is too concentrated in the executive, opportunities to contribute are limited and less involved in parliamentary special select committees. For example, nine out of 10 special select committees of the Dewan Rakyat are chaired by backbenchers.

Therefore, we urge the administration of the new government and Parliament to take responsibility and be committed to reforming the Parliament institution as well as empowering the special select committees. The following are Bersih 2.0’s proposed reforms as contained in our latest research paper:

  • Amendments to the standing Orders to expand the powers of special select committees, improve the appointment process, give flexibility over meetings, uphold the responsibility of the executive to provide feedback on the findings of special select committees, review the composition of special select committee, and provide live broadcast of activities carried out by special select committees
  • Strengthen the role and power of special select committees to obtain evidence and conduct its own inquiries and investigations
  • Revisit the procedure for the appointment of special select committee members so that the membership is balanced and proportional to the overall representation in the Houses. It is also suggested that members be selected through the nomination process and members be allowed to choose their own special select committees according to their interests and expertise.
  • Institutionalise the opposition by recognising the leader of the opposition as equivalent to a cabinet minister
  • Conduct live broadcasts of all special select committee work for public viewing to build public trust and confidence in the institution of Parliament
  • Give flexibility to special select committees to determine their own form of meetings, which should not be limited only in the premises of Parliament. Moreover, it is a need during the current pandemic to be given the facility to hold meetings in virtual or hybrid mode
  • Increase the number of special select committees in both the House of Representatives and the Senate based on specific needs as well as to fill the monitoring gap in the current ministries that are not monitored
  • Allocate an adequate budget allocation to ensure their efficient functioning and smooth operation. The chairman of the special select committees should be given a separate allowance under the Members of Parliament (Remuneration) Act 1980
  • Provide sufficient personnel by expanding the size of the special select committee secretariats including researchers, experts, clerks and support staff. At least two researchers should be allocated to each special select committees
  • Provide continual and periodic training to all MPs and special select committee secretariats on best practices and the latest developments related to parliamentary institutions.
