Kerajaan baru perlu bertindak segera memulihkan kepercayaan awam terhadap Suruhanjaya Pilihan Raya

[ENGLISH VERSION BELOW] Gabungan Pilihan Raya Bersih Dan Adil (Bersih 2.0) menyambut baik pengiktirafan Jawatankuasa Reformasi Institusi oleh ‘Council Of Elders’ sebagai satu langkah yang baik oleh kerajaan baru dalam memulakan proses reformasi institusi seperti yang telah dijanjikan dalam manifesto PH.

Pada 23 Mei, Bersih 2.0 menyerahkan satu pelan tindakan reformasi pilihan raya kepada Jawatankuasa Reformasi Institusi untuk mengimplementasi secara strategik proses reformasi yang dicadangkan dalam garis masa tertentu (rujuk lampiran). Dalam keadaan fokus dan gerak kerja kebanyakannya telah mula ditumpukan kepada isu 1MDB, Bersih 2.0 menekankan bahawa reformasi pilihan raya juga perlu dimulakan segera, bertujuan untuk memastikan pilihan raya yang bersih, bebas dan adil selaras dengan visi Malaysia baru dalam janji yang dinyatakan oleh kerajaan PH.

Walaupun terdapat banyak bukti yang kukuh dan masalah pengurusan dalam pilihan raya umum 2018, tidak ada satu pun pesuruhjaya mahupun pegawai Suruhanjaya Pilihan Raya (SPR) yang tampil bertanggungjawab. Pengerusi SPR Mohd Hashim Abdullah dan timbalannya Othman Mahmood dan lima lagi pesuruhjaya yang lain sehingga hari ini tanpa segan silu memegang jawatan tersebut dan tidak mahu meletakkan jawatan serta mengambil tanggungjawab.

Bersih 2.0 sekali lagi menekankan bahawa tindakan terpenting yang perlu diambil segera adalah untuk mengembalikan kebebasan dan fungsi SPR kerana tiada reformasi yang akan berlaku sekiranya SPR yang sedia ada dikekalkan. Tujuh pesuruhjaya SPR perlu meletakkan jawatan segera kerana telah kehilangan kepercayaan awam dan bersubahat dalam salahlaku pilihan raya.

Bersih 2.0 menyeru Jawatankuasa Reformasi Institusi dan kerajaan untuk segera memberikan perhatian kepada reformasi dan implementasi berdasarkan pelan tindakan ini dalam tempoh 100 hari dan dua tahun berikutnya.

Untuk memulakan proses reformasi tersebut, Bersih 2.0 menyeru perdana menteri untuk memulakan proses penggantungan pengerusi SPR Mohd Hashim Abdullah dan timbalannya Othman Mahmood bagi menjalankan siasatan dan penyingkiran seperti yang termaktub dalam Artikel 114(7) Perlembagaan Persekutuan.

Seterusnya, satu tribunal perlu ditubuhkan untuk menyingkirkan tujuh pesuruhjaya SPR sedia ada bagi memberi laluan kepada barisan pesuruhjaya baru yang lebih kompeten, dipercayai dan bebas untuk mengambil alih. Tribunal tersebut boleh diambil alih oleh Yang di-Pertuan Agong, atas nasihat perdana menteri, merujuk kepada Artikel 114(7) dan Artikel 125(2) Perlembagaan Persekutuan.

Langkah drastik ini diperlukan segera bagi memastikan kebebasan dan integriti SPR dibina semula serta pesuruhjaya-pesuruhjaya yang berkenaan dipertanggungjawabkan atas kegagalan mereka mengangkat nilai ketelusan pilihan raya.

New government must act immediately to restore public confidence in Electoral Commission

The Coalition for Clean and Fair Elections (Bersih 2.0) welcomes the establishment of the Institutional Reform Committee by the Council of Elders as a step in the right direction by the new government in starting the institutional reform process as promised in Pakatan Haparan’s manifesto.

On 23 May, Bersih 2.0 has submitted to the Institutional Reform Committee an electoral reform action plan to strategically implement the proposed reforms within specified time frames (please refer to the attachment). While a lot of attention and work has already begun on the 1MDB issue, Bersih 2.0 emphasises the urgent need for electoral reforms to also start immediately, with the purpose of bringing about clean, free and fair elections in line with the vision of a new Malaysia as promised by the Pakatan Harapan (PH) government.

Despite blatant evidence of all the frauds and mismanagement that took place in the 2018 general election, not a single commissioner or officer of the Electoral Commission has been held accountable. The chief commissioner Hashim Abdullah, his deputy Othman Mahmood and the other five commissioners have to this day unashamedly held on to their positions and refused to resign and take responsibility.

Bersih 2.0 reiterates that the most important action to take immediately is to restore the independence and function of the Electoral Commission, as no meaningful reforms can take place if the present commissioners are not removed. The seven members of the commission must resign immediately as they have lost public confidence and are complicit in electoral malpractices.

Bersih 2.0 calls on the Institutional Reform Committee and the government to immediately begin looking into the reforms and its implementation within the first 100 days and subsequently the next two years.

To kick start the reform process, Bersih 2.0 calls on the prime minister to initiate the process of suspending the chief commissioner of the Electoral Commission, Mohd Hashim Abdullah and his deputy, Othman Mahmood, pending investigation and a complete removal as stated under Article 114(7) of the Federal Constitution.

Subsequently, a tribunal should be established to remove all the seven current commissioners in order for a new batch of competent, credible and independent commissioners to take over. Such a tribunal could be established by the Yang di-Pertuan Agong, on the advice of the prime minister, in accordance with Article 114(7) and Article 125(2) of the Federal Constitution.

Such drastic steps are urgently necessary to ensure that the independence and integrity of the Electoral Commission can be restored and that these commissioners are held accountable and answerable for failing to uphold the sanctity of the elections.
