‘Kerajaan madani’ digesa patuhi larangan ‘tiga C’ agar tidak salah guna kuasa (Malay/English)

[ENGLISH VERSION BELOW] Gabungan Pilihan Raya Bersih dan Adil (Bersih) menggesa kerajaan “madani” yang dipimpin oleh Perdana Menteri Anwar Ibrahim untuk mematuhi larangan “tiga C”: “no conditions” (tidak bersyarat), “no campaign” (tidak berkempen) dan “no candidates” (tidak bawa calon) supaya tidak menyalahgunakan kuasa dan membelakangi amanah dalam sebarang pengumuman dasar dan peruntukan oleh semua kementerian dan agensi persekutuan dalam tempoh enam pilihan raya negeri ini.

Bersih merujuk kepada pengumuman daripada Timbalan Perdana Menteri Zahid Hamidi merangkap Menteri Kemajuan Desa dan Wilayah kepada Persatuan Belia Gabungan Lembaga Kemajuan Terengganu Tengah (Ketengah) untuk menambah geran kepada persatuan tersebut sebanyak RM100,000. Selain itu, beliau juga mengumumkan peruntukan sebanyak RM250,000 kepada Majlis Belia Terengganu dan RM200,000 bagi persatuan permotoran di negeri tersebut. Jumlah peruntukan yang diumumkan semasa program “sentuhan kasih desa” itu berjumlah lebih setengah juta ringgit.

Zahid dalam ucapannya secara jelas mengenakan syarat apabila menambah bahawa jumlah peruntukan ini akan dinaikkan sekiranya parti beliau menang dalam pilihan raya negeri ini dan berkempen di hadapan para belia yang hadir untuk memenangkan arus merah biru yang merujuk kepada gabungan parti kerajaan dalam pilihan raya kali ini .

Peruntukan yang khas kepada tiga badan sosial di Terengganu dan bukan untuk semua badan yang sejenis seluruh negara telah melanggar prinsip tidak berkempen (no campaign) manakala kenyataan Zahid yang mengaitkan jumlah peruntukan kepada kemenangan pilihan raya negeri terang-terang melanggar prinsip tidak bersyarat (no conditions).

Ini berlainan dengan pengumuman oleh Anwar kerangka ekonomi baru “ekonomi madani” yang merangkumi seluruh rakyat Malaysia dan tidak mengaitkan sebarang peruntukan dengan sokongan politik.

Bersih menggesa dengan tegas untuk Perdana Menteri Anwar mengawal anggota kabinet beliau dan semua ketua agensi persekutuan untuk tidak secara semberono membuat pengumuman dasar atau peruntukan yang melanggar larangan tiga C.

Tidak boleh ada pengumuman khas yang disasarkan kepada negeri-negeri yang menghadapi piliran raya negeri untuk menarik sokongan. Sudah tentu tidak boleh ada sebarang calon dalam upacara pengumuman. Sebarang pengumuman sebelum ini yang bersyarat, termasuk kenyataan Zahid di Terengganu, mesti dibatalkan serta-merta.

Anwar Ibrahim dan “kerajaan madani” perlu ingat bahawa pelanggaran tiga C ini cuma akan menjejaskan kredibiliti gagasan madani, sehingga ia dilihat sebagai satu propaganda kepartian dan bukan idealisme untuk seluruh negara.

Sebagai penggerak pilihan raya bersih dan adil serta reformasi institusi yang tidak memihak mana-mana parti, berfikir secara mendalam dan tidak bertindak secara terburu-buru, larangan tiga C itu telah dikemukakan oleh Bersih pada 20 Julai untuk mengawal kerajaan yang tidak bersifat sementara (non-caretaker government), iaitu kerajaan persekutuan dalam pilihan raya negeri dan kerajaan-kerajaan negeri semasa pilihan raya umum.

Bersih bersyukur bahawa nilai keberkecualian pentadbiran (administrative neutrality) yang mengikat kerajaan sementara (caretaker government) telah diterima sebagai norma asas dalam pilihan raya.

Larangan tiga C adalah untuk menutup lubang bagi kerajaan-kerajaan bukan sementara tanpa melarang mereka daripada melaksanakan amanah-amanah masing-masing. Garis panduan ini bersama-sama dengan etika kerajaan sementara harus dikanunkan sebagai akta/enakmen keberkecualian pentadbiran dalam pilihan raya (administrative neutrality in elections act or enactment) di kedua-dua peringkat persekutuan dan negeri.

Bersih akan sentiasa bersikap adil, seimbang dan berkecuali dalam memantau tingkahlaku semua parti politik dan wakil rakyat. Sungguhpun ini akan mengundang tohmahan daripada parti-parti politik dan organ-organ propaganda mereka, Bersih tidak akan takut kepada tohmahan dan tidak akan beranjak daripada membuat teguran membina, munasabah dan matang dengan suara yang jelas dan tegas. – Bersih

‘Madani government’ urged to comply with ‘three Cs’ prohibition to avoid abuse of power

The Coalition for Clean and Adil Elections (Bersih) urges the “madani government” led by Prime Minister Anwar Ibrahim to comply with the “three Cs” prohibition: “no conditions”, “no campaign” and “no candidates” so as not to abuse power and abandon trust in any policy announcements and allocations by all federal ministries and agencies during the six state elections.

Bersih refers to the announcement by Deputy Prime Minister Zahid Hamidi, who is also Minister of Rural and Regional Development, to the Persatuan Belia Gabungan Lembaga Kemajuan Terengganu Tengah (the Central Terengganu Development Authority’s youth association coalition) to increase the grant to the association by RM100,000. In addition, he also announced an allocation of RM250,000 to the Terengganu Youth Council and RM200,000 for motoring associations in the state. The total allocations announced during the “sentuhan kasih desa (touch of love for villages) programme amounted to over half a million ringgit.

Zahid in his speech clearly imposed conditions when he added that the amount of this allocation will be increased if his party wins in this state election and campaigned in front of the youth present to win the “red and blue wave”, which refers to the parties in the coalition government in this election.

The special allocation to three social bodies in Terengganu and not to all similar bodies throughout the country has violated the principle of “no campaign” while Zahid’s statement linking the amount of allocation to a state election victory clearly violates the principle of “no conditions”. This is different from the announcement by Prime Minister Anwar of the new economic framework “ekonomi madani” (civil economy), which includes everyone in Malaysia and does not link any provision with political support.

Bersih strongly urges the PM to control his cabinet members and all heads of federal agencies to not recklessly make policy announcements or provisions that violate the three Cs prohibition.

There should be no special announcements targeted at states facing an election to attract support. Of course, there cannot be any candidates in any announcement ceremony. Any previous conditional announcements, including Zahid’s statement in Terengganu, must be cancelled immediately.

PM Anwar and the “madani government” (civil government) must remember that this violation of the three Cs will affect the credibility of the Madani ideas, as it will be seen as party propaganda and not a policy vision for the whole country.

As an electoral watchdog for clean and fair elections and institutional reforms which do not favor any party, Bersih mooted the three Cs ban on 20 July as a guideline for a government that is in a ‘non-caretaker’ mode, ie the federal government, in these state elections, and the state governments during a general election. Bersih is glad that the value of administrative neutrality – which we have advocated over the years – that binds caretaker governments has now been accepted as a basic norm in elections.

The three Cs prohibition is intended to close the loophole for non-caretaker governments without prohibiting them from carrying out their respective mandates. These guidelines together with the code of ethics for caretaker governments should be legislated as an administrative neutrality in election act or enactment, at both the federal and state levels.

Bersih will always be fair, balanced and impartial in monitoring the behavior of all political parties and elected representatives. Although this may sometimes invite slander from political parties and their propaganda organs, Bersih will not bow to slander and will not move away from making constructive, considered and mature reprimands with a clear and firm voice. – Bersih
