Kurang percaya kepada institusi awam disebabkan kekurangan kebebasan berinstitusi (Malay/English)

[ENGLISH VERSION BELOW] Gabungan Pilihan Raya Bersih dan Adil (Bersih 2.0) mengulangi seruan kami kepada reformasi undang-undang untuk membebaskan institusi awam utama daripada cengkaman dan pengaruh eksekutf iaitu Pejabat Perdana Menteri untuk mengembalikan kepercayaan orang ramai terhadap institusi-institusi tersebut dan supaya ada garis pemisahan kuasa yang jelas di antara ketiga-tiga cabang kerajaan.

Kami merujuk kepada suara orang ramai daripada pelbagai segmen masyarakat berkenaan pertuduhan rasuah terhadap bekas Menteri Kewangan Lim Guan Eng, pendakwaan bekas PM Najib Razak dan pengguguran pertuduhan Musa Aman dan Riza Aziz daripada rasuah dan penggubahan wang haram.

Persepsi orang ramai terhadap pendakwaan terpilih atau kekebalan daripada pendakwaan tidak dapat dielakkan oleh kerana kuasa melantik jawatan utama – seperti peguam negara yang juga pendakwa raya, ketua pesuruhjaya Suruhanjaya Pencegahan Rasuah Malaysia (SPRM), ketua polis negara, ahli-ahli Suruhanjaya Pelantikan Kehakiman, ketua hakim negara, presiden Mahkamah Rayuan, ketua hakim-hakim dan banyak lagi institusi yang lainnya – adalah di bawah kuasa perdana menteri.

Besih 2.0 menyeru pelantikan utama ini dikeluarkan daripada kuasa Perdana Menteri dan proses-proses pelantikannya dibuat secara telus kepada orang ramai dan diteliti oleh jawatankuasa pilihan khas parlimen yang berkenaan, kecuali pelantikan kehakiman yang prosesnya perlu bebas daripada sebarang campur tangan politik.

Kebebasan institusi-institusi ini tidak akan sempurna tanpa reformasi yang diperlukan untuk memastikan autonomi kewangan dan pelantikan staf. Sehingga reformasi ini dilembagakan dalam undang-undang dan diamalkan, tindakan, keputusan dan integriti oleh institusi ini akan sentiasa dipersoalkan serta menjadi satu pencemaran nama oleh kerja baik yang mereka lakukan.

Kerajaan Pakatan Harapan telah berjanji untuk melaksanakan reformasi ini dalam manifesto mereka namun gagal untuk menunaikannya melalui pindaan undang-undang walaupun mereka telah mengumumkan bahawa mereka membebaskan institusi ini secara pentadbiran. Peluang yang dilepaskan kini kembali menghantui mereka.

Bersih 2.0 telah mengeluarkan kenyataan bersama Gabungan Bertindak Malaysia dan Angkatan Belia Islam Malaysia (Abim) bertajuk “Enam perkara persetujuan pelbagai parti bagi penjajaran semula politik dan penamatan komplot parti tidak berkesudahan” bahawa perlunya ada kesataraan di sisi undang-undang.

Dalam mengembalikan kebebasan dan keadilan melalui reformasi kehakiman, satu pejabat pendakwa raya yang bebas dan tidak politikal perlu segera ditubuhkan supaya Jabatan Peguam Negara dapat beroperasi secara berasingan serta menjalankan tugas utamanya untuk mendraf undang-undang dan memberikan nasihat perundangan kepada kerajaan.

Ketidakstabilan politik dalam negara yang disebabkan oleh parti atau gabungan yang melompat adalah kesan langsung daripada pendakwaan oleh kerajaan yang memerintah hari ini. Semua orang ingin bersama siapa saja yang memegang kuasa di persekutuan untuk meloloskan diri daripada salah laku, sama ada benar atau dipalsukan.

Sementara itu, kami mengharapkan institusi seperti SPRM, peguam negara, polis dan kehakiman akan terus mendesak untuk reformasi serta menjalankan tugas mereka secara profesional dan telus. Sesiapa sahaja yang didakwa, proses undang-undang mesti dipatuhi dan berdasarkan bukti yang nyata.

Trust deficit in public institutions due to lack of institutionalised independence

The Coalition for Clean and Fair Elections (Bersih 2.0) reiterates our call for legal reforms to free key public institutions from the control and influence of the executive, that is, the Prime Minister’s Office, so that public confidence in these institutions could be restored and that there is a clear separation of powers between the three branches of government.

We refer to the public outcries by various segments of society over the recent charges of corruption against former Finance Minister Lim Guan Eng, the conviction of former PM Najib Razak, even the acquittals of Musa Aman and Riza Aziz of corruption and money- laundering charges.

Public perception of selective prosecution or immunity from prosecution is unavoidable as the power to appoint people into key positions – such as the attorney general, who is also the public prosecutor, the commissioners of the Malaysian Anti-Corruption Commission (MACC), the inspector general of police, the chief justice, the president of the Court of Appeal, chief judges, members of the Judicial Appointments Commission, and many other institutions – lies in the hand of the Prime Minister.

Bersih 2.0 calls for key appointments to be taken out of the PM’s hands and the processes be transparent to the public and scrutinised by the relevant parliamentary select committees except in the case of judicial appointments where the process must be absolutely independent and free from political interference.

The independence of these institutions will not be complete without necessary reforms to ensure their autonomy in finance and staffing. Until such reforms are codified in law and put into practice, the actions, decisions and integrity of these institutions will always be questioned – and discredit some of the good work done by them.

The Pakatan Harapan government had promised to implement such reforms in their manifesto but failed to deliver them through legal amendments even though it declared that it had set them free administratively. Its missed opportunity is now coming back to haunt it.

Bersih 2.0 had stated previously issued a joint statement with Gabungan Bertindak Malaysia and Angkatan Belia Islam Malaysia (Abim) called the “Six-point multi-party deal to reconfigure multiparty competition and end the endless machinations” that there should be equality before the law, that while judicial reform to restore its independence and impartiality must continue, an independent and non-political public prosecutor’s office must be quickly established so that the Attorney General’s Chambers can operate separately with providing legal advice to the government and the drafting of laws as its main functions.

The current political instability in this country caused by party or coalition-‘hopping’ is the direct result of such perceived persecution by the government of the day. Everyone wants to be aligned with whoever is holding federal power to escape action against wrongdoings, whether real or fabricated.

Meanwhile, we hope that these institutions – MACC, the Attorney General’s Chambers, the police and the judiciary – will themselves push for reforms and carry out their public duties professionally and transparently. If anyone is convicted, due process of the law must be followed and based on irrefutable evidences.
