[ENGLISH VERSION BELOW] Gabungan Pilihan Raya Bersih dan Adil (Bersih 2.0) mengalu-alukan saranan timbalan presiden Pas agar pihak Suruhanjaya Pilihan Raya (SPR) dapat mengawasi dan menguatkuasakan undang-undang, peraturan dan etika pilihan raya.

Malah ini adalah seruan dan gesaan Bersih 2.0 selama ini; namun kita juga perlu maklum bahawa berdasarkan undang-undang yang ada sekarang, kuasa SPR adalah terhad.

Berdasarkan Perkara 113 Perlembagaan Persekutuan, SPR hanya berkuasa untuk menjalankan dan menguruskan urusan pilihan raya seperti mendaftarkan dan menyediakan daftar pemilih, menjalankan pilihan raya Dewan Rakyat dan dewan indangan negeri dan mengkaji semula persempadanan pilihan raya.

SPR terpaksa bergantung kepada pihak polis, Suruhanjaya Pencegahan Rasuah Malaysia dan Suruhanjaya Komunikasi dan Multimedia untuk menyiasat kesalahan-kesalahan pilihan raya sekiranya terdapat aduan berkenaan perkara tersebut.

Justeru, Bersih 2.0 mengajak semua pihak termasuk parti pembangkang untuk menyokong pindaan undang-undang yang dapat memberikan kuasa perundangan kepada SPR bagi menjalankan siasatan terhadap aduan-aduan berkenaan kesalahan pilihan raya serta kuasa mengajukan kes-kes kepada pendakwaraya untuk membuat pendakwaan terhadap pelaku yang terlibat sekiranya mereka benar-benar serius ingin melihat penguatkuasaan undang-undang berkenaan kesalahan pilihan raya dalam negara kita.

Pihak pembangkang juga perlu menyokong pindaan undang-undang untuk menjadikan SPR sebuah badan yang bebas, termasuk proses pelantikan ahli-ahli suruhanjaya yang telus dan bebas bagi memastikan SPR mandiri serta tidak dipengaruhi oleh mana-mana pihak.

Pelantikan jawatan bagi institusi awam utama seperti SPR wajib melalui suatu jawatankuasa pelantikan yang akan menerima pencalonan daripada semua pihak berkepentingan termasuklah daripada orang awam dan seterusnya jawatankuasa tersebut akan menyenarai pendek pencalonan.

Calon-calon yang disenarai pendekkan ini kemudiannya diserahkan kepada Jawatankuasa Khas parlimen bagi Memilih Calon yang mendapat keyakinan awam sebelum diserahkan kepada perdana menteri yang akan memberi nasihat kepada Yang Dipertuan Agong untuk membuat pelantikan.

Proses ini perlu dijadikan sebagai sebahagian daripada undang-undang agar proses pelantikan tersebut menjadi lebih telus dan berperlembagaan.

Bersih 2.0 menyeru pihak pembangkang untuk menyokong perkara yang dinyatakan serta pindaan yang dapat memperkukuhkan integriti institusi awam utama seperti SPR. Pengukuhan institusi seperti SPR dapat menjamin ketelusan dalam sistem serta menguatkan lagi demokrasi dalam negara kita.

Opposition should support law amendments to empower Electoral Commission

The Coalition for Clean and Fair Elections (Bersih 2.0) agrees with the statement by Pas deputy president Tuan Ibrahim Tuan Man that the Electoral Commission should strictly monitor and enforce election laws, regulations and ethics.

This has been Bersih 2.0’s call over the years, but we must also note that under the current laws the Electoral Commission’s power is limited.

Based on Article 113 of the Federal Constitution, the Electoral Commission is the only authority to conduct and administer electoral matters such as the registration of voters and the preparation of the electoral roll, to conduct parliamentary and state elections and to carry out delimitation exercises.

The Electoral Commission has to rely on the police, the Malaysian Anti-Corruption Commission and the Communications and Multimedia Commission to investigate election offences when complaints are lodged.

Hence, Bersih 2.0 would like to call on all parties including opposition parties, if they are serious and sincere, to support any amendments to the law that would empower the Electoral Commission to conduct investigations into complaints of election offences and to bring charges against offenders.

The opposition should also support legal amendments to make the Electoral Commission more independent and not under the influence of the government of the day.

Appointments to key public institutions such as the Electoral Commission must be through a nomination committee, which will receive nominations from all stakeholders including the public, and then shortlist suitably qualified candidates.

The shortlisted candidates should then be submitted to the parliamentary Select Committee for Major Appointments, which will look for the candidate that can command the confidence of the public before submitting it to the prime minister or even the king for appointment. This process needs to be made a part of the law to make the appointment process more transparent and constitutional.

Bersih 2.0 hopes that the opposition will agree with what we have outlined and support any amendments that will strengthen the integrity of key public institutions such as the Electoral Commission. Strengthening institutions such as the Electoral Commission can ensure greater transparency in the system and strengthen democracy in our country.
