Gabungan Pilihan Raya Bersih dan Adil (Bersih 2.0) kesal dengan sabitan terhadap Mohd Fakhrulrazi oleh Mahkamah Seksyen pada pagi 25 Ogos 2016.

Beliau dijatuhi hukuman penjara lapan bulan di bawah Akta Hasutan 1948 kerana berpatisipasi dalam himpunan #KitaLawan yang menuntut pembebasan Anwar Ibrahim.

Sabitan ini adalah satu kemunduran dalam kebebasan bersuara di Malaysia. Fakhrulrazi tidak sepatutnya ditahan mahupun di dakwa Akta Hasutan 1948 yang drakonian ini.

Pada tahun 2015, Akta Hasutan telah dipinda dan dengan jelas menyatakan bahawa pengkritik kerajaan dan pentadbiran tidak boleh ditahan dan didakwa dibawah akta ini. Namun, akta ini terus diguna-pakai untuk menyekat kebebasan ini,terutamanya selepas Mohamed Apandi Ali mengambil-alih jawatan ketua peguam negara.

Selain daripada Fakhrulrazi, lapan lagi aktivis termasuk pengerusi Bersih 2.0 Maria Chin Abdullah dan pengurus Bersih 2.0 Mandeep Singh turut didakwa kerana menyertai himpunan #KitaLawan tahun lepas.

Pentadbiran Najib dilihat lebih cenderong bertindak untuk mendakwa kumpulan masyarakat sivil dan aktivis walaupun pada hari ini Malaysia sedang berhadapan dengan skandal korupsi global yang terbesar dalam sejarah Malaysia. Sehingga saat ini, tidak ada seorang pun didakwa ekoran skandal #1MDB.

Bersih 2.0 sekali lagi menyatakan sokongan ke atas Gerakan Hapus Akta Hasutan (GHAH) yang menuntut untuk menyemak semula dan menggugurkan kesemua tuduhan terhadap tertuduh dan menghentikan segala pendakwaan selepas ini. Akta ini harus di mansuhkan serta-merta.

Fakhrulrazi’s jailing is also the jailing of Malaysians’ freedom of expression

The Coalition for Free and Fair Elections (Bersih 2.0) deplores the conviction of Mohd Fakhrulrazi by the Kuala Lumpur Sessions court on 25 August 2016.

He was sentenced to eight months of jail under the Sedition Act 1948 for calling for the release of Anwar Ibrahim during the #KitaLawan rally last year. Fakhrulrazi is the youth vice-chief of Parti Amanah Negara.

Fakhrulrazi’s conviction is another huge step backwards for freedom of expression in Malaysia. In the first place, the attorney general should not have initiated the charged under the flawed Sedition Act.

Since Mohamed Apandi Ali took office, the majority of the sedition cases had to do with criticism of the government or the administration of justice which had been repealed under the 2015 amendments.

Besides Fakhrulrazi, eight other activists, which includes Bersih 2.0 chairperson Maria Chin Abdullah and Bersih 2.0 manager Mandeep Singh, were also charged for participating in the #KitaLawan rally last year.

The Najib administration seems to be more interested in cracking down on civil society and activists, although Malaysia is facing the largest corruption scandal in our history. To date, not a single arrest or charge has been made with regard to the 1MDB scandal.

Bersih 2.0 supports the Abolish The Sedition Act Movement (GHAH)’s demands for the immediate review and dropping of all existing sedition charges, and a moratorium on any further sedition charges pending a full review of the Act and its abolishment.
