Pengerusi Bersih 2.0 dipanggil polis untuk siasatan (Malay/English)

[ENGLISH VERSION BELOW] Gabungan Pilihan Raya Bersih dan Adil (Bersih 2.0) ingin memaklumkan kepada orang ramai bahawa pengerusi Bersih 2.0 Thomas Fann telah menerima panggilan daripada pihak polis untuk disiasat di bawah Seksyen 9(5) Akta Perhimpunan Aman 2012 berkaitan satu kiriman di laman Facebook rasmi kami pada 29 Februari 2020.

Kiriman tersebut menggesa rakyat yang tidak setuju dengan pengkhianatan mandat rakyat akibat oleh Langkah Sheraton untuk menyertai satu protes yang dipanggil “Turun Ke Jalan: Demokrasi Mati” di Dataran Merdeka pada malam tersebut.

Fann akan ke ibu pejabat Polis Dang Wangi untuk disoal siasat pada 7 Julai 2020 pada pukul 11 pagi. Beliau akan diiringi seorang peguam apabila memberikan keterangan kepada pihak polis.

Bersih 2.0 mengingatkan sekali lagi kerajaan Perikatan Nasional bahawa hak berhimpunan secara aman dan kebebasan bersuara, berekspresi dan berpersatuan adalah termaktub di bawah Perkara 10 Perlembagaan Persekutuan.

Perlu dimaklumkan juga bahawa seruan kami untuk menyertai protes aman tersebut adalah dibuat sebelum arahan perintah kawalan pergerakan.

Kami kesal di bawah kerajaan PN Muhyiddin Yassin, era ugutan politik dan membisukan suara penentangan yang merupakan kebiasaan di bawah era Barisan Nasional sudah kembali.

Selain daripada Fann, dalam beberapa minggu ini juga terdapat beberapa individu yang dipanggil untuk soal siasat. Antaranya adalah:

  • pengasas-pengarah Center to Combat Corruption and Cronyism (C4) Cynthia Gabriel dipanggil kerana satu kenyataan media bertajuk “Anti-rasuah tidak akan menyucikan kerajaan Perikatan Nasional”
  • Ahli Parlimen Segambut Hannah Yeoh disebabkan mesej Twitternya
  • Ahli Parlimen Muar Syed Saddiq bagi temuramah beliau di Al-Jazeera
  • aktivis Siti Kasim disebabkan kiriman Facebook
  • wartawan Tashny Sukumaran kerana laporan serbuan warga asing tanpa dokumen semasa tempoh perintah kawalan pergerakan

Pada 14 Jun, pengacara dan pelakon terkenal, Patrick Teoh telah didakwa di bawah Seksyen 233(1)(a) Akta Komunikasi dan Multimedia di atas tuduhan membuat penghinaan dengan sengaja untuk menyakitkan hati orang lain kepada Tengku Mahkota Johor di kiriman Facebook.

Tindakan undang-undang juga telah dikenakan kepada portal berita Malaysiakini kerana tuduhan komen hasutan yang dikirim oleh pelanggannya ke atas judisiari, dan penerbit buku Gerakbudaya telah diserbu oleh polis kerana kulit buku yang berimej seperti jata negara.

Bersih 2.0 berpandangan sekatan terhadap kebebasan asasi sebagai simptom kerajaan yang kurang keyakinan dan yang tidak mempunyai legitimasi selepas perampasan kuasa politik empat bulan sebelum ini.

Sehingga hari ini, Muhyddin masih menafikan peluang Parlimen untuk mengesahkan dakwaan beliau bahawa kerajaannya mempunyai sokongan majoriti ahli-ahli parlimen.

Bersih 2.0 menggesa semua rakyat Malaysia untuk bersolidariti dengan semua pihak yang sedang diugut dan mempertahankan kebebasan asasi yang dijamin oleh Perlembagaan Persekutuan. Kami akan terus bergerak tanpa rasa gentar dan takut.

Bersih 2.0 chairperson called in for questioning by police

The Coalition for Clean and Fair Elections (Bersih 2.0) wishes to inform the public that our chairperson, Thomas Fann, received a call from the police to be investigated under Section 9(5) of the Peaceful Assembly Act 2012 in relation to a posting on our official Facebook page on 29 February 2020, urging citizens unhappy with the betrayal of the people’s mandate brought about by the Sheraton Move to attend a protest called “Turun Ke Jalan: Demokrasi Mati” at the Dataran Merdeka that night.

Fann will present himself at the Dang Wangi Police headquarters to be questioned on the 7 July 2020 at 11am. He will be accompanied by a lawyer when he gives his statement to the police.

Bersih 2.0 reminds the Perikatan Nasional government that the right to peaceful assembly as well the right to free speech, expression and association is enshrined under Article 10 of our Federal Constitution.

It should also be noted that our call for people to join peaceful protests was well before the “movement control order” was implemented.

We regret that under the new PN government of Muhyiddin Yassin, the era of political intimidation and silencing of dissent that was so common under Barisan Nasional seems to have returned in full force.

Apart from Fann, in recent weeks others have been similarly called in for questioning:

  • Founding director of Center to Combat Corruption and Cronyism, Cynthia Gabriel for a press statement entitled “Anti-corruption will never purify the unelected Perikatan Nasional government”
  • Segambut MP Hannah Yeoh for a Twitter message
  • Muar MP Syed Saddiq for his TV interview on Al Jazeera
  • Activist Siti Kasim for a Facebook posting
  • Journalist Tashny Sukumaran for reporting on the crackdown on undocumented migrants during the movement control order

On 14 June, well-known disc jockey and actor Patrick Teoh was charged under Section 233(1)(a) of the Communications and Multimedia Act for allegedly making an insulting Facebook post about the Crown Prince of Johor with the intention to hurt the feelings of others.

Legal action was also taken against news portal Malaysiakini for allegedly offensive comments posted by its subscribers against the judiciary, and book publisher Gerakbudaya was raided by the police over a book cover with an image that resembles the national coat of arms.

Bersih 2.0 views such restrictions on fundamental liberties as symptomatic of an insecure government which has not established its own legitimacy after the political coup that took place four months ago. Till today, Muhyiddin has denied Parliament the opportunity to affirm his claim that his government commands the support of the majority of MPs.

Bersih 2.0 calls on all Malaysians to stand in solidarity with all those who are being intimidated and to defend our fundamental liberties that are guaranteed by our Federal Constitution. As for us, we will not be intimidated nor defeated.

I apologise first if I appear to be biting into Malaysiakini and refusing to let go! But i am really disappointed with its cowardly stance recently.
Given that the security units of the backdoor govt. are harassing critics it is perhaps understandable to me now why editors/moderators of Mkini tremble at words like ‘moron’ ‘eunuch’ and ‘as*min’ to describe political operatives.

” …that the right to peaceful assembly as well the right to free speech, expression and association is enshrined under Article 10 of our Federal Constitution.” If even Malaysiakini dares not stand up for freedom of expression, it should disable the Comments feature and just be like The Star.
