Pilihan raya kecil Tanjung Piai: Pastikan padang permainan sama rata (BM/ENG)

[ENGLISH VERSION BELOW] Gabungan Pilihan Raya Bersih dan Adil (Bersih 2.0) merasa kecewa bahawa kerajaan Pakatan Harapan (PH) masih menyalahgunakan kedudukan mereka sebagai kerajaan persekutuan apabila bertanding dalam pilihan raya kecil.

Telah dilaporkan bahawa Menteri Pembangunan Luar Bandar Rina Harun membuat kunjungan kementerian di parlimen Tanjung Piai pada 15 Oktober dan memberikan geran kepada jawatankuasa pengurusan Tanjung Piai.

Meskipun undang-undang yang ada masih belum menjadikan perbuatan tersebut sebagai satu kesalahan untuk kerajaan menggunakan kedudukan dan sumber kerajaan untuk berkempen bagi parti politik mereka, namun ianya bercanggah dengan prinsip pilihan raya adil dan bersih apabila tidak ada pemisahan antara peranan kerajaan dan tugas parti di dalam kempen pilihan raya.

Bersih 2.0 sedar bahawa semasa pilihan raya kecil, fungsi kerajaan perlu diteruskan kerana ianya tidak realistic untuk berhenti setiap kali adanya pilihan raya kecil, dan pilihan raya kecil Tanjung Piai adalah pilihan raya kecil ke-sembilan sejak pilihan raya umum 2018. Namun kami mahu mencadangkan garis panduan berikut bagi memastikan padang permainan yang sama rata bagi semua parti yang bertanding semasa pilihan raya kecil.

  • Lawatan dan majlis rasmi kementerian ke kawasan yang akan menghadapi pilihan raya kecil perlu dihentikan sebaik speaker Dewan Rakyat atau dewan undangan negeri mengisytiharkan kekosongan kerusi
  • Tidak ada sumber kerajaan seperti dana awam, staf dan kenderaan boleh digerakkan oleh menteri dan timbalan menteri yang sedang berkempen sebagai pemimpin parti, dengan pengecualian terhadap kenderaan khas serta anggota keselamatan khas untuk keselamatan mereka
  • Sekiranya pesawat kerajaan, helicopter atau bot yang digunakan untuk perjalanan ke kawasan pilihan raya kecil, kos-kos yang setara untuk menyewakan apa-apa kenderaan dari entiti persendirian perlu dibayar kepada perbendaharaan
  • Sebarang peruntukan baru, pengumuman projek atau bantuan tidak boleh diberikan eksklusif kepada kawasan pilihan raya kecil sahaja tetapi perlu diberikan ke seluruh negara atau negeri
  • Janji bersyarat yang berbentuk material atau wujudnya pertimbangan yang berharga yang bergantung kepada kemenangan calon, terutamanya parti kerajaan, boleh dianggap sebagai satu bentuk rasuah, di mana ianya adalah kesalahan di bawah Seksyen 10 Akta Kesalahan Pilihan Raya 1954

Bersih 2.0 menyeru kerajaan PH untuk meletakkan standard yang tinggi bagi etika pilihan raya dan mematuhi Akta Kesalahan Pilihan Raya 1954 serta undang-undang lain yang berkaitan.

Bersih 2.0, bersama-sama Jawatankuasa Pembaikan Sistem dan Undang-Undang Pilihan Raya (ERC) kini sedang membuat semakan yang menyeluruh terhadap undang-undang pilihan raya sedia ada bagi memperjelaskan beberapa kesalahan, untuk memasukkan beberapa pertimbangan yang baru dan untuk memperkasakan Suruhanjaya Pilihan Raya dalam penguatkuasaan undang-undang pilihan raya.

Sehingga cadangan ini menjadi undang-undang, kami menggesa semua parti untuk memantau undang-undang yang sedia ada serta prinsp pilihan raya yang bebas dan adil agar para pengundi dapat membuat pilihan yang bermaklumat berdasarkan isu yang penting bagi mereka serta kawasan mereka, dan bukannya kerana takut atau tekanan yang tidak munasabah dikenakan kepada mereka.

Tanjung Piai by-election: Ensure level playing field

The Coalition for Clean and Fair Elections (Bersih 2.0) is dismayed that the Pakatan
Harapan (PH) government continues to abuse its position as the federal government when
it comes to competing in by-elections. It was reported that Rural Development Minister Rina Harun made a ministerial visit to the Tanjung Piai parliamentary constituency (P165) on 15
October and handed out grants to the Tanjung Piai management committees.

While current laws do not make it an offence for incumbent governments to use their
position and state resources to campaign for their political parties, the principle of free and
fair elections was violated when there was no separation of government roles and party duties in election campaigning.

Bersih 2.0 is aware that during by-elections, the function of government should continue as it
would be unrealistic to pause every time there is a by-election, and the Tanjung Piai
by-election is the ninth since the 2018 general election. We would recommend the following guidelines to ensure a level playing field for all competing parties in a by-election.

  • Official ministerial visits and functions to the constituency facing a by-election should
    cease the moment the speaker of Parliament or state assemblies declares a seat
    vacant.
  • No government resources like public funds, facilities, staff and vehicles should be
    deployed by ministers and deputy ministers who are campaigning as party leaders, except for assigned vehicles and personnel for their security
  • If any government aircraft, helicopters and boats are used to travel to the by-election
    constituency, the equivalent cost of chartering such a conveyance from a private entity
    should be paid to the Treasury
  • Any new allocations and announcements of projects or relief should not be exclusive to the constituency undergoing a by-election but it should be state or nationwide.
  • Conditional promises that are material in nature or have valuable consideration that is
    dependent on a candidate winning, especially by a party in government, can be deemed to
    be a form of bribery, which is an offence under Section 10 of the Election Offences Act 1954

Bersih 2.0 calls on the PH government to set a higher standard for electioneering and for
compliance with the Election Offences Act 1954 and other relevant laws.

Bersih 2.0, together with the Electoral Reform Committee, is currently undertaking a
comprehensive review of existing election laws with a view to bringing clarity to certain
offences, to including new areas of concern and to empowering the Electoral Commission to
enforce the election laws.

Until our recommendations become law, we call on all parties to observe existing laws and
the principle of free and fair elections so that voters could make informed choices based on
issues that are important to them and their constituencies and not out of any sense of fear or any unreasonable pressure placed on them.

There is still no difference between the past & present Government.
It all zero talk of Integrity, Quality, Transparency, Equality in this so called current promise land previously know as Bolehland. The only change seen now is that as a citizen we have just jumped from the frying pan into the fire…….
