Pisahkan pengurusan pilihan raya di Malaysia kepada tiga suruhanjaya (Malay/English)

[ENGLISH VERSION BELOW] Gabungan Pilihan Raya Bersih dan Adil (Bersih 2.0) mencadangkan agar badan pengurusan pilihan raya di Malaysia dibahagikan kepada tiga suruhanjaya yang mempunyai autonomi dan bidang kuasa yang berlainan.

Pemecahan badan pengurusan pilihan raya ini dicadangkan agar pengurusan pilihan raya di Malaysia dilaksanakan dengan lebih efisen, cekap dan bebas.

Ketika ini, Suruhanjaya Pilihan Raya (SPR) memikul semua bebanan tugas pelaksanaan pilihan raya seperti pendaftaran pemilih, persempadanan semula kawasan pilihan raya, penjalanan pilihan raya seperti penamaan calon dan penguatkuasaan Akta Kesalahan Pilihan Raya dengan bantuan daripada agensi lain seperti polis.

Cadangan ini dibuat berdasarkan laporan kajian yang telah dilancarkan oleh Bersih 2.0 [pada 8 Februari] yang bertajuk “Tiga lebih baik: Reformasi institusi bagi pengurusan pilihan raya di Malaysia”. Kajian ini telah dijalankan oleh Chan Tsu Chong di bawah naungan Bersih 2.0.

Bersih 2.0 mencadangkan agar Suruhanjaya Pilihan Raya dipecahkan kepada tiga suruhanjaya iaitu:

Suruhanjaya Pilihan Raya (SPR)

Suruhanjaya ini masih bertanggungjawab untuk proses pelaksanaan pilihan raya seperti pendaftaran pemilih, penamaan calon, pelaksanaan hari pengundian, penjumlahan undi dan pengisytiharan keputusan pilihan raya.

Suruhanjaya penguatkuasa pilihan raya

Tanggungjawab suruhanjaya ini adalah untuk memantau dan memastikan pematuhan kesemua undang-undang berkaitan pilihan raya termasuklah Akta Pilihan Raya 1958 dan Akta Kesalahan Pilihan Raya 1954.

Selain itu, suruhanjaya ini juga akan bertanggungjawab meregulasi pendaftaran dan pengurusan parti politik termasuklah pendanaan parti politik dan laporan tahunan parti politik.

Suruhanjaya ini akan mempunyai kuasa menyiasat, mengeluarkan waran dan memanggil suspek serta saksi. Ia juga boleh menubuhkan tribunal pilihan raya untuk menerima aduan dan melakukan siasatan.

Suruhanjaya ini hendaklah dianggotai oleh ketua polis negara, ketua Pesuruhjaya Suruhanjaya Pencegahan Rasuah Malaysia, peguam negara serta empat orang ahli suruhanjaya yang dilantik berdasarkan kepakaran. Daripada empat orang ini, dua daripadanya harus dilantik daripada pertubuhan masyarakat sivil.

Suruhanjaya persempadanan

Suruhanjaya ini adalah satu suruhanjaya yang ditubuhkan secara ad-hoc apabila wujud keperluan melakukan persempadanan semula berdasarkan peruntukan Jadual Ketiga Belas, Perlembagaan Persekutuan. Kami mencadangkan supaya Jadual Ketiga Belas ini dipinda bagi memberikan suruhanjaya ini kuasa pemutus muktamad untuk meluluskan cadangan persempadanan.

Suruhanjaya ini perlu dianggotai oleh seorang hakim Mahkamah Persekutuan, seorang ahli SPR, seorang ahli suruhanjaya penguatkuasa pilihan raya, pengarah Jabatan Tanah dan Ukur, pengarah Jabatan Perangkaan Negara dan dua orang ahli yang mempunyai kelayakan yang sah serta berpengalaman sekurang-kurangnya 10 tahun dalam pilihan raya, statistik dan geografi.

Bersih 2.0 mencadangkan agar ketiga-tiga suruhanjaya ini bebas sepenuhnya daripada kuasa eksekutif serta perkhidmatan awam dan kesemua suruhanjaya ini hendaklah dipantau dan melaporkan kepada Jawatankuasa Pilihan Khas Parlimen berkenaan Urusan Pilihan Raya di Parlimen.

Untuk urusan penamaan calon-calon yang layak menganggotai suruhanya ini, Bersih 2.0 mencadangkan agar satu kawatankuasa khas penamaan Suruhanjaya Pilihan Raya dibentuk untuk menapis dan menyenarai pendek calon-calon yang berkompentensi untuk dipersembahkan kepada Yang di-Pertuan Agong, yang kemudiannya Agong akan melantik ahli-ahli suruhanjaya tersebut.

Jawatankuasa ini hendaklah dianggotai oleh perdana menteri, ketua pembangkang, pengerusi dan seorang ahli dari Jawatankuasa Pilihan Khas Parlimen untuk Urusan Pilihan Raya, ketua hakim negara, pengerusi Suruhanjaya Hak Asasi Manusia (Suhakam), presiden Majlis Peguam dan seorang ahli daripada pertubuhan masyarakat sivil.

Bersih 2.0 percaya bahawa reformasi yang paling utama adalah untuk reformasi pilihan raya dan institusi dengan mereformasi badan pengurusan pilihan raya agar badan pengurusan pilihan raya ini dilihat telus, efisien dan mendapat keyakinan rakyat untuk memegang amanah bagi menjalankan pilihan raya. Keyakinan rakyat sangat bergantung kepada ketelusan proses pilihan raya dan badan pengurusan pilihan raya ini mempunyai semak dan imbang yang secukupnya. – Jawatankuasa pemandu Bersih 2.0

Split electoral management in Malaysia into three commissions

The Coalition for Clean and Fair Elections (Bersih 2.0) proposes that the electoral management body in Malaysia be split into three commissions with different jurisdictions and autonomies.

This division is proposed so that electoral management in Malaysia can be implemented more efficiently, effectively and independently.

Currently, the Election Commission bears all the workload of electoral conduct such as voter registration, constituency delimitation and conduct of elections such as nominations and enforcement of the Election Offences Act with assistance from other agencies including the police.

The proposal was made based on a research report, launched by Bersih 2.0 [on 8 February] entitled “Three is better than one: Institutional reforms for electoral management in Malaysia”. This study was conducted by Chan Tsu Chong and commissioned by Bersih 2.0.

The three proposed commissions should be:

Election Commission

The commission maintains the responsibility for the conduct of election processes such as voter registration, nominations, polling, vote counting and tabulation and announcement of election results.

An election enforcement commission

The commission’s responsibility is to monitor and ensure compliance with all election-related laws, including the Elections Act 1958 and the Election Offences Act 1954.

The election enforcement commission would be also be responsible for regulating political parties’ registration, including political financing and reporting requirements. It would have the power to investigate, issue warrants and summon suspects and witnesses. It could can also set up an electoral tribunal to receive complaints and conduct investigations.

This commission shall consist of the inspector general of police, the chief commissioner of the Malaysian Anti-Corruption Commission, the attorney general and four other members appointed based on expertise. Of these four, two should be appointed from civil society organisations.

An electoral boundaries commission

This commission should be established on an ad-hoc basis when there is a need for a re-delineation exercise according to the provisions of the Thirteenth Schedule of the Federal Constitution.

We propose that this Thirteenth Schedule be amended to give the commission be the final authority to approve the delineation proposal.

The electoral boundaries commission must consist of a Federal Court judge, a member of Election Commission, a member of the election enforcement, a director general of the Department of Survey and Mapping, the chief statistician and two individuals with appropriate valid qualifications and at least 10 years’ experience in elections, statistics and geography.

Bersih 2.0 proposes that these three commissions be completely independent of the executive as well as the civil service and that all these commissions should be monitored by and report to the Parliamentary Select Committee on Electoral Matters in Parliament.

For the nomination of candidates who are eligible to be members of these commissions, Bersih 2.0 proposes that an electoral commission nomination committee shall be formed to shortlist the candidates who are competent to be presented to the Yang di-Pertuan Agong, who will appoint the members of these commissions. The committee shall consist of the prime minister, the opposition leader, the chairman and a ranking member of the parliamentary Select Committee on Electoral Matters, the chief justice, the chairman of the Human Rights Commission (Suhakam), the president of the Bar Council, and a civil society organisation member.

Bersih 2.0 believes electoral and institutional reform is crucial, and this should happen by reforming the electoral management body so that it is seen as transparent, efficient and has the public support to conduct elections.

The confidence of the people is highly dependent on the transparency of the election process and if there are sufficient institutional checks and balances to the electoral management body. – Bersih 2.0 steering committee
