Sahkan sokongan MB Johor di dewan negeri melalui undi percaya (Malay/English)

[ENGLISH VERSION BELOW] Gabungan Pilihan Raya Bersih dan Adil (Bersih) memandang serius isu pelantikan menteri besar Johor baru-baru ini.

Hal ini berikutan pelantikan menteri besar Johor selain dari calon tunggal menteri bersar Barisan Nasional semasa pilihan raya negeri Johor, Hasni Mohamad. Namun, Sultan Johor telah memperkenan dan melantik Onn Hafiz Ghazi yang merupakan ahli dewan undangan negeri Machap menjadi menteri besar Johor.

Bersih melihat perkara ini berpotensi mewujudkan ketidakstabilan politik sekali lagi di Johor sekiranya sistem yang sedia ada tidak diperbaharui bagi mengesahkan sokongan dewan negeri terhadap menteri besar Johor yang baharu.

Bersih menggesa Menteri Besar Johor Onn Hafiz membentangkan undi percaya terhadap dirinya sendiri bagi mengabsahkan sokongan ahli di dalam Dewan terhadap beliau. Undi percaya ini penting kerana sebelum ini BN telah menamakan Hasni sebagai calon menteri besar Johor semasa kempen pilihan raya, dan dikatakan 38 ahli dewan daripada BN telah menandatangani akuan bersumpah bagi menyokong Hasni sebagai menteri besar.

Bersih juga menggesa kerajaan negeri Johor di bawah BN untuk meminda Perlembagaan Negeri Johor dan peraturan mesyuarat dewan negeri bagi mewajibkan undi pengesahan kepercayaan (confirmatory vote of confidence) kepada menteri besar baharu selepas selesai pilihan raya atau di pertengahan penggal bagi mengabsahkan menteri besar yang dilantik serta mengurangkan kebarangkalian pertukaran kerajaan pada pertengahan penggal.

Selain itu, undi tidak percaya secara konstruktif (constructive vote of no confidence) juga perlu diperkenalkan di dewan negeri bagi menetapkan bahawa seseorang menteri besar tidak boleh dijatuhkan kecuali jika undi tidak percaya juga mengandungi nama penggantinya yang diluluskan dengan majoriti mudah; justeru tiada pilihan raya mengejut diperlukan jika menteri besar baharu dapat digantikan dengan kaedah sedemikian.

Bersih berpandangan pindaan-pindaan ini adalah sangat mustahak untuk mengelakkan percaturan politik yang tidak berkesudahan dan akan menambahkan keyakinan rakyat kepada demokrasi berparlimen dan sistem raja berperlembagaan serta dapat memastikan kestabilan politik yang lebih kukuh. – Bersih

Confirm Johor menteri besar’s support through vote of confidence

The Coalition for Clean and Fair Elections (Bersih) views with serious concern the recent issue of the Johor menteri besar’s appointment.

This follows the appointment of a different menteri besar from the Barisan Nasional’s sole candidate during the recent Johor state election, Hasni Mohamad. Since then, the Johor Sultan has assented and appointed Onn Hafiz Ghani, the state assembly member for Machap, to be the new menteri besar.

Bersih sees that this has the potential to create instability in Johor if the current system is not reformed to allow the state assembly to confirm the support for the new menteri besar of Johor.

Bersih urges Menteri Besar Onn Hafiz to table a vote of confidence in himself to prove he has the support of the majority of members in the state assembly. The vote of confidence is vital as BN had previously, in its election campaign, designated Hasni as their candidate for menteri besar, and it is said that 38 BN assembly members had signed statutory declarations to support Hasni as menteri besar.

Bersih urges the Johor state government under BN to amend the Johor State Constitution and standing orders of the state assembly to establish a confirmatory vote of confidence mechanism to confirm the appointment of any new menteri besar after an election or in midterm to validate the legitimacy of a new menteri besar, thus reducing the possibility of a midterm change of government.

A constructive vote of no confidence should also introduced in the state assembly so that the menteri besar cannot be ousted unless the vote of no confidence contains the name of his successor approved by a simple majority. No snap elections will be required if a menteri besar can be replaced by such a method.

Bersih believes these amendments are very important to avoid endless political machinations, to increase the people’s confidence in parliamentary democracy and constitutional monarchy and to ensure greater political stability. – Bersih
