SPR dan Jabatan Pendaftaran perlu jelaskan isu salah guna kad pengenalan untuk mengundi (Malay/English)

[ENGLISH VERSION BELOW] Gabungan Pilihan Raya Bersih dan Adil (Bersih) sangat bimbang dengan laporan yang menyatakan pengundi tidak dapat mengundi kerana kad pengenalan mereka telah digunakan dalam enam pilihan raya negeri yang lalu.

Pihak kami menggesa pihak Suruhanjaya Pilihan Raya serta Kementerian Dalam Negeri dan Jabatan Pendaftaran Negara untuk memberi penjelasan berkenaan isu ini.

Penyalahgunaan kad pengenalan pihak lain untuk mengundi dalam pilihan raya adalah satu kesalahan pilihan raya di bawah Seksyen 3(1)(l) dan Seksyen 7 Akta Kesalahan Pilihan Raya, iaitu mengundi di bahagian pilihan raya yang tidak berhak untuk mengundi dan kesalahan penyamaran.

Berdasarkan laporan pemerhati Bersih, kami telah mendapati sebanyak tiga pengundi tidak dapat mengundi kerana kad pengenalan mereka telah digunakan untuk pengundian, yang menyebabkan nama mereka telah dipotong dalam senarai daftar pemilih. Tiga pengundi tersebut adalah di Sekolah Menengah Kebangsaan Seberang Marang, Terengganu, Sekolah Kebangsaan Kampung Raja Uda, Selangor dan Sekolah Kebangsaan Taman Mahsuri, Kedah.

Pihak polis juga telah membuat kenyataan bahawa mereka telah menerima sebanyak 94 laporan berkenaan kesalahan yang sama. Pada pilihan raya umum 2022, kami juga telah menerima tiga laporan nama pengundi telah dipotong dalam senarai daftar pemilih yang menandakan ada pihak lain yang mengundi bagi pihak mereka.

Trend ini menunjukkan peningkatan ketara berbanding pilihan raya-pilihan raya sebelum ini seperti pilihan raya umum 2022, pilihan raya negeri Melaka, Sarawak dan Johor.

Maka SPR perlu segera melakukan siasatan dalam di pusat-pusat pengundian yang dilaporkan terjadinya kesalahan ini terhadap petugas-petugas pilihan raya terutamanya kerani pengundian pertama dan kedua yang bertanggungjawab untuk mengesahkan identiti setiap pemilih yang datang mengundi melalui semakan senarai daftar pemilih dan membuat pengecaman wajah di kad pengenalan pengundi. Siasatan perlu dijalankan sama ada kerani pengundian pertama dan kedua ini telah melakukan tugas mereka berdasarkan akta dan peraturan yang ditetapkan.

Pihak Jabatan Pendaftaran yang berada di bawah Kementerian Dalam Negeri juga perlu melakukan siasatan yang telus dan menjelaskan isu ini kepada umum. Penyalahgunaan kad pengenalan dan penyamaran untuk mengundi dalam pilihan raya adalah kesalahan yang berat kerana hal ini telah menyebabkan pengundi sebenar dinafikan hak mereka untuk mengundi, sekali gus menjejaskan integriti daftar pemilih dan penjalanan pilihan raya itu sendiri.

Bersih juga menggesa agar Jawatankuasa Pilihan Khas Parlimen Hak Asasi Manusia, Pilihan Raya dan Reformasi Institusi yang rentas parti untuk menyiasat perkara ini dan melakukan siasatan di peringkat Parlimen, termasuk mendapatkan laporan-laporan penjalanan pilihan raya oleh SPR seperti butiran perbelanjaan, isu-isu pilihan raya dan isu daftar pemilih.

Election Commission, Registration Department must clarify misuse of identity cards to vote

The Coalition for Clean and Fair Elections (Bersih) is deeply concerned by reports that voters were unable to vote because their identity cards were used by other individuals in the six state elections.

We urge the Election Commission and the Ministry of Home Affairs and the National Registration Department to provide an explanation regarding this issue.

The misuse of another person’s identity card to vote in an election is an election offence under Section 3(1)(l) and Section 7 of the Election Offences Act, which is voting in an electoral division where one is not entitled to vote and an impersonation offence.

Based on the report by Bersih election observers, we have found out that three voters were unable to vote because their identity cards were used for voting, which caused their names to be crossed out from the voting list for this election. The three voters were at at Seberang Marang National Secondary School, Terengganu, the Kampung Raja Uda National School, Selangor, and the Taman Mahsuri National School, Kedah.

The police have also made a statement that they have received as many as 94 reports regarding the same offence. In the 2022 general election, we also received three reports of voters’ names being crossed out from the list, indicating that others had voted on their behalf.

This current reports show a significant increase compared to previous elections, such as the 2022 general election and the Malacca, Sarawak and Johor state elections.

Therefore, the Election Commission needs to immediately carry out an internal investigation at the polling centres where the errors have been reported against the election officials, especially the first and second polling clerks, who are responsible for verifying the identity of each voter who comes to vote by reviewing the electoral roll and identifying faces on the voter’s identity card. An investigation needs to be conducted as to whether the first and second polling clerks have performed their duties based on the act and regulations set.

The Registration Department, which is under the Ministry of Home Affairs, also needs to conduct a transparent investigation and explain this issue to the public. The misuse of identity cards and impersonation to vote in elections is a serious offence because this has denied real voters their right to vote and affected the integrity of the electoral roll and the conduct of the election itself.

Bersih also urged the parliamentary Special Select Committee on Human Rights, Elections, and Institutional Reform to carry out a cross-party investigation into this matter and conduct an investigation at the parliamentary level, including obtaining reports on the conduct of elections by the Election Commission, such as details of expenses, election issues and voter registration issues. – Bersih
