Tolak kluster mahkamah dalam kabinet baharu (Malay/English) – Bersih

[ENGLISH VERSION BELOW] Gabungan Pilihan Raya Bersih dan Adil (Bersih) bimbang mengenai sesetengah pihak dan individu yang mencadangkan presiden Umno Zahid Hamidi perlu dipertimbangkan untuk memegang jawatan timbalan perdana menteri dalam kabinet Perdana Menteri Anwar Ibrahim.

Bersih menolak dengan tegas sebarang pelantikan wakil rakyat yang sedang menjalani pendakwaan jenayah ke sebarang jawatan kabinet kerana hal yang demikian akan menjejaskan integriti kerajaan pimpinan Anwar dan mencemarkan reputasi negara kita.

Zahid masih dalam perbicaraan untuk pelbagai pendakwaan rasuah termasuk kes Yayasan Akalbudi walaupun beliau telah dibebaskan daripada tuduhan skim visa VLN oleh Mahkamah Tinggi pada 22 September, namun pasukan pendakwaan telah mengemukakan rayuan untuk kes tersebut.

Wakil rakyat yang sedang menjalani kes rasuah, seperti Lim Guan Eng, Syed Saddiq Syed Abdul Rahman dan Bung Moktar Radin, tidak boleh dilantik ke dalam kabinet Malaysia sehingga kes mereka selesai sepenuhnya oleh mahkamah tanpa sebarang campur tangan eksekutif melalui Jabatan Peguam Negara.

Bersih berpandangan bahawa sehingga dan melainkan kedua-dua pihak pendakwaan dan kehakiman benar-benar bebas daripada pengaruh politik, ahli politik yang masih mempunyai kes mahkamah mengambil jawatan eksekutif adalah sangat tidak boleh diterima kerana sebarang pembebasan akan dilihat sebagai pemberian pengampunan kepada mereka yang di pihak eksekutif, walaupun kes mereka secara meritnya layak dibebaskan. Hal ini akan merendahkan integriti kedua-dua Jabatan Peguam Negara dan kehakiman.

Bersih menggesa semua parti dalam kerajaan gabungan campuran ini untuk mengelakkan menamakan individu yang dalam kes mahkamah kepada PM untuk pertimbangan beliau dalam proses pembentukan kabinet.

Bersih menggesa semula desakan untuk mereformasi Jabatan Peguam Negara dengan memisahkan kuasa untuk mendakwa. Sebagai langkah segera, peranan pendakwaan perlu dipindahkan sementara peguam cara negara, jawatan kedua yang tidak politik di Jabatan Peguam Negara, untuk mengambil pendirian neutral terhadap semua kes yang sedang berjalan, terutamanya melibatkan ahli politik. Pengurusan kes-kes ini tidak boleh dijadikan alat tawar-menawar untuk pembentukan kerajaan atau kabinet. – Bersih

No ‘court cluster’ in new cabinet

The Coalition for Free and Fair Elections (Bersih) is alarmed that certain parties and individuals are suggesting that Zahid Hamidi, the president of Umno, should be considered for the post of deputy prime minister in Prime Minister Anwar Ibrahim’s cabinet.

Bersih strongly objects to the appointment of any person who has an ongoing criminal case against him or her to any cabinet position as he or she will raise doubts about the integrity of Anwar’s government and tarnish the reputation of our country.

Zahid is still on trial for numerous corruption charges involving the Yayasan Akalbudi case, even though he had been acquitted on the VLN visa scheme case by the High Court on 22 September, but the prosecution has filed an appeal for this case.

Similarly, other elected representatives who have ongoing corruption cases such as Lim Guan Eng, Syed Saddiq Syed Abdul Rahman and Bung Moktar Radin, should not be appointed to the Malaysian cabinet until after their cases have been fully disposed of by the courts without any interference from the executive through the Attorney General’s Chambers.

Bersih opines that until and unless both the prosecution and the judiciary are absolutely free from political influence, politicians with outstanding court cases taking up executive positions are politically unacceptable, as any acquittals will be seen as the granting of impunity to those aligned with the executive, even if their cases genuinely merited acquittal. This would undermine the integrity of both the Attorney General’s Chambers and the judiciary.

Bersih urges all parties in this mixed coalition government to refrain from putting forward any names of individuals with ongoing court cases to the PM for consideration as he forms his cabinet.

Bersih reiterates the urgent need to reform the Attorney General’s Chambers by separating its powers to prosecute. As an immediate measure, the prosecution role should be temporarily transferred to the solicitor general, the apolitical No 2 in the Attorney General’s Chambers, to take a neutral position on all ongoing cases, especially those involving politicians. The handling of these cases should not be used as bargaining chips for the formation of government or the cabinet. – Bersih
