[ENGLISH VERSION BELOW] Gabungan Pilihan Raya Bersih dan Adil (Bersih 2.0) terkejut dengan kenyataan Menteri Pertahanan Ismail Sabri yang menyatakan mereka yang positif Covid-19 tidak dibenarkan untuk mengundi di dalam pilihan raya negeri Sabah pada hari Sabtu ini.
Mereka yang mempunyai gejala seperti demam dan batuk serta yang dikuarantin pula akan dibenarkan untuk mengundi.
Hak warganegara untuk mengundi adalah termaktub di dalam Perlembagaan Persekutuan dan tidak ada mana-mana orang boleh sewenang-wenangnya menafikan, termasuklah menteri atau kabinet khas.
Perkara 119(1) menyatakan tiap-tiap warganegara berhak mengundi di dalam bahagian pilihan raya itu dalam mana-mana pilihan raya ke Dewan Rakyat atau dewan undangan melainkan hilang kelayakan di bawah Fasal (3) atau di bawah mana-mana undang-undang yang berhubungan dengan kesalahan yang dilakukan berkaitan pilihan raya.
Fasal (3) menyatakan seseorang kehilangan kelayakan sekiranya ditahan kerana tidak sempurna akal atau dalam hukuman pemenjaraan selama melebihi 12 bulan.

Suruhanjaya Pilihan Raya (SPR) bertanggungjawab untuk melaksanakan proses pembuangan undi termasuk kepada mereka yang positif Covid-19 semasa pilihan raya negeri Sabah. SPR perlu membuat pengurusan khas Covid-19 untuk mengundi dari wad hospital dengan bantuan daripada pegawai perubatan yang terlatih.
Ini juga seiiring dengan Garis Panduan Pencegahan Covid-19 Dalam Pelaksanaan Pilihan Raya yang dikeluarkan oleh SPR, di mana dinyatakan bahawa pesakit yang positif Covid-19 Ttidak dibenarkan untuk keluar hospital bagi tujuan mengundi.
Kita bernasib baik mempunyai ketua pengarah kesihatan dan petugas kesihatan yang profesional yang tidak mengenal lelah berada di barisan hadapan untuk memastikan rakyat dalam keadaan selamat. Kami yakin dengan sokongan daripada mereka, ratusan kes pesakit Covid-19 di Sabah dapat melaksanakan tanggungjawab mereka sebagai pengundi dengan selamat.
Bersih 2.0 berpandangan sekiranya SPR gagal untuk membantu pesakit Covid-19 mengundi di pilihan raya negeri Sabah pada hari Sabtu ini, SPR boleh dikenakan tindakan undang-undang kerana tidak memenuhi tanggungjawab kepada pengundi.
Selain itu, pegawai pilihan raya yang dengan sengaja menghalang mana-mana pengundi daripada mengundi akan melakukan kesalahan di bawah Seksyen 4(d) Akta Kesalahan Pilihan Raya.
Bersih 2.0 bersedia untuk memberi bantuan guaman kepada mana-mana pesakit Covid-19 yang dinafikan hak untuk mengundi pada hari Sabtu ini. Mereka yang ingin berbuat demikian boleh menghubungi kami di emel [email protected] selepas 26 September 2020.
Kami menyeru SPR untuk memenuhi tanggungjawab mereka dan terus melaksanakan pilihan raya walaupun dalam krisis kesihatan serta menunjukkan kepada rakyat Malaysia kepentingan dan nilai setiap satu undi.

Voting is a constitutional right that cannot be denied even during a pandemic
The Coalition for Clean and Fair Elections (Bersih 2.0) is appalled with the statement by Defence Minister Ismail Sabri that those who are confirmed Covid-19 positive would not be allowed to vote in the Sabah state election on Saturday while others who have symptoms like fever and coughing and those quarantined will be allowed to vote.
A citizen’s right to vote is enshrined in the Federal Constitution and no one can arbitrarily take that right away, not even a government minister or a special cabinet.
Article 119(1) states that “every citizen is entitled to vote in that constituency in any election to the House of Representatives or the Legislative Assembly unless he is disqualified under Clause (3) or under any law relating to offences committed in connection with elections”.
Clause (3) disqualifies those who are of unsound mind and those serving imprisonment of more than 12 months.
The Election Commission is duty-bound to facilitate the casting of votes, including for those who are found to be Covid-19 positive during this Sabah state election by making special arrangement for these patients to vote from the safety of hospital wards with the assistance of trained medical staff.
This would be in compliance with the Guidelines for Prevention of Covid-19 During Elections, issued by the Election Commission, which states that Covid-19 positive patients are not allowed to leave the hospital to cast their votes.
We are fortunate to have a highly competent health director general and professional healthcare workers who are at the frontlinse to keep us safe. We are confident that, with their support, the several hundred cases of Covid-19 patients in Sabah who are eligible to vote can do so safely.
Bersih 2.0 is of the view that if the Election Commission fails to facilitate voting for Covid-19 patients in Sabah on Saturday, they would be liable to legal action for failing to fulfil their obligation to voters.
Further, any person or election officers who wilfully prevents any person who is entitled to vote from voting would have committed an offence under Section 4(d) or Section 9 of the Election Offences Act 1954.
Bersih 2.0 stands ready to provide legal assistance to any Covid-19 patients who are prevented from exercising their right to vote this Saturday. They should contact us by email at [email protected] soon after 26 September 2020.
We call on the Election Commission to fulfil its duty and rise to the challenge of conducting elections safely even during a health crisis and demonstrate to the Malaysian public the importance of voting and the value of every single vote.
