Orang Asli di Kampung Sungai Kelubi rasa kesal setelah tanah adat mereka dicerobohi oleh syarikat swasta. Lapuran oleh Mor Arjani (English version below).
Kampung Orang Asli Sungai Kelubi terletaknya di sebelah Bandar Country Homes Rawang, Selangor. Pada beberapa bulan yang lepas, tanah kebun sawit milik penduduk Kampung Orang Asli Sungai Kelubi yang luasnya 24 ekar telah diceroboh oleh pihak luar.
Kebun sawit ini dimiliki oleh 12 pemilik individu terdiri dari penduduk kampung tersebut, sebanyak dua ekar seorang. Menurut ketua kampung tersebut iaitu Batin Nek bin Asang sebelum berlakunya pencerobohan, pegawai Jabatan Kemajuan Orang Asli daerah Hulu Selangor ada datang bermesyuarat dengan penduduk Kampung Orang Asli Sungai Kelubi.
Pegawai tersebut menyatakan bahawa tanah kebun sawit milik Kampung Orang Asli Sungai Kelubi bukan merupakan tanah milik orang kampung di situ tetapi milik orang lain. Pegawai Jabatan Kemajuan Orang Asli daerah Hulu Selangor tersebut meyakinkan agar penduduk di situ memulakan perbincangan dengan menawarkan pampasan pokok sahaja kepada pemilik kebun.
Oleh kerana tidak berpuas hati dengan kenyataan pegawai Jabatan Kemajuan Orang Asli daerah Hulu Selangor tersebut, Batin Nek bin Asang telah membuat semakan sendiri di Pejabat Tanah Daerah Hulu Selangor yang terletak di Kuala Kubu Bharu.

Pejabat Tanah Daerah Hulu Selangor menyatakan bahawa tanah kebun sawit berkenaan memang terdapat di dalam peta rizab Tanah Adat kampung Orang Asli Sungai Kelubi.
Oleh kerana dapat mengetahui Batin Nek bin Asang telah menyemak pelan tanah di pejabat tanah daerah Hulu Selangor; pegawai jabatan telah mengadakan mesyuarat sulit dengan pengerusi Jabatan Kemajuan dan Keselamatan Kampung (JKKK) Sungai Kelubi. Ini telah dilakukan secara senyap, membelakangi Batin Nek bin Asang selaku ketua kampung Orang Asli Sungai Kelubi Rawang.
Mereka berdua ini kemudiannya telah berjaya meyakinkan pemilik tanah kebun sawit bahawa tanah kebun tersebut bukan milik orang kampung di situ tetapi milik orang lain. Mereka menawarkan pampasan pokok dengan jumlah kira-kira RM5,000 untuk satu ekar tanah.
Sembilan orang pemilik kebun sawit telah menerima pampasan pokok tersebut manakala tiga lagi pemilik enggan menjual kebun sawit mereka. Selang beberapa minggu setelah pembayaran pampasan pokok itu dibuat sampailah jentera berat jenis Hitachi untuk membersihkan kawasan kebun tersebut.
Pada ketika kebun sawit sedang giat dibersihkan oleh jentera Hitachi, Batin Nek bin Asang telah membuat laporan polis di balai polis Taman Desa, Rawang, Selangor berkenaan pencerobohan tersebut. Batin Nek bin Asang menyatakan di dalam laporan polis itu bahawa beliau membantah pencerobohan jentera berat yang sedang membersihkan tanah kebun sawit milik penduduk kampung Orang Asli Sungai Kelubi.
Beliau juga menafikan beliau terlibat dalam pencerobohan tanah tersebut dan beliau menyatakan segala perbincangan di antara pengerusi JKKK Kampung Orang Asli Sungai Kelubi dengan Pegawai Jabatan Kemajuan Orang Asli daerah Hulu Selangor mengenai pampasan pokok tanah kebun kampung berkenaan tidak ketahui oleh beliau.
Beberapa minggu setelah tanah kebun sembilan daripada 12 pemilik kebun yang menerima pampasan pokok siap dibersihkan, tiga lagi kebun sawit kampung berkenaan turut diceroboh. Setelah ketiga-tiga pemilik kebun pergi ke pejabat Jabatan Kemajuan Orang Asli daerah Hulu Selangor untuk membantah pencerobohan tersebut, pegawai memanggil seorang ahli perniagaan dari Tanjong Karang untuk memberikan pampasan pokok kepada mereka.
Pada saat itu, baharu penduduk kampung sedar yang pihak penceroboh adalah sebuah syarikat dari Tanjong Karang, Selangor. Tanah kebun sawit milik penduduk kampung Orang Asli Sungai Kelubi tiba-tiba bertukar status menjadi lot 2996 dan lot 3487. Pegawai jabatan juga menyuruh pemilik kebun itu menandatangani satu surat supaya tidak lagi membuat apa-apa tuntutan terhadap tanah kebun mereka.
Sekarang pencerobohan tanah di kebun kampung Orang Asli Sungai Kelubi bukan sahaja di kebun sawit tetapi melarat juga ke kebun getah milik penduduk kampung di sana.
Batin Nek bin Asang amat bimbang semakin hari semakin banyak Tanah Adat di kampung Orang Asli Sungai Kelubi diceroboh. Batin Nek bin Asang juga pernah menghantar surat bantahan kepada kerajaan Selangor untuk membantah tindakan pencerobohan tanah di kampung tersebut melalui wakilnya tetapi sampai sekarang tiada apa-apa tindakan dibuat oleh kerajaan Selangor untuk membantu menyelesaikan kes pencerobohan tanah kebun sawit kampung Orang Asli Sungai Kelubi.
Batin Nek bin Asang berasa amat kesal kerana tidak sesiapa pun sudi membantunya sedang tanah kampungnya terus dicerobohi. Semakin hari tanah di kampung tersebut semakin mengecil.

Encroachment into the ancestral land of Kampung Orang Asli Sungai Kelubi
Kampung Sungai Kelubi is situated beside the town of Country Homes in Rawang, Selangor. A few months ago, outsiders encroached into into the 24-hectare oil palm estate co-owned by the residents of the Kampung Orang Asli Sungai Kelubi.
The land of the oil palm estate is co-owned by 12 individuals from the village (each person owns two hectares).
According to Batin Nek bin Asang who is the head of the village, before the encroachment, an officer from the Department for the Development of the Indigenous Peoples of Hulu Selangor (Jabatan Kemajuan Orang Asli Hulu Selangor) had arranged a meeting with the villagers. The officer had informed the villagers during the meeting that the oil palm plantation land was not owned by the villagers but by some other party.
The officer persuaded the villagers to begin negotiations with the real owner of the land to obtain monetary compensation based on the number of oil palm trees on the land. Batin Nek bin Asang was not convinced by the officer’s story and went to the District Land Office for Hulu Selangor at Kuala Kubu Bharu and checked the status of the land. The district land office informed him that the land was within the delineated area of ancestral land for the indigenous peoples of Sungai Kelubi (Tanah Adat).
The officer, however, found out that Batin Nek bin Asang had gone to the district land office and checked the status of the land; so the officer is believed to have held a secret meeting with the head of the village’s Safety and Security Council. Both of them then allegedly convinced the co-owners of the land that the land was not owned by them.
They offered a compensation based on the oil palm trees that came to around RM5,000 for each hectare of land involved. Nine of the co-owners agreed with the compensation while three others refused. A few weeks after the money was paid, Hitachi-type heavy machinery arrived to clear the land.
While the oil palm estate land was being cleared, Batin Nek bin Asang made a police report at the Taman Desa, Rawang police station regarding the encroachment into the land.
In the report, he stated his protest at the intrusion and the clearing of the land. He also denied he was involved in the encroachment, saying he was not aware of any negotiations between the head of the Safety and Security Council (JKKK) of the village and the officer from the Department for the Development of the Indigenous Peoples of Hulu Selangor (Jabatan Kemajuan Orang Asli Hulu Selangor) regarding the compensation for the co-owners.
A few weeks after the land of the nine co-owners who had received the compensation was cleared, the intruders encroached into the land of the three other co-owners who had refused to receive the compensation. After the three co-owners went to the Hulu Selangor district Indigenous People Development Office (Jabatan Kemajuan Orang Asli) to protest, the officer called a businessman from Tanjong Karang to provide compensation to the three of the co-owners.
At that moment, the villagers realised that the party that had encroached into their land was a company from Tanjong Karang. Suddenly the status of the land had changed to lot 2996 and lot 3487. The officer also allegedly made the co-owners sign a document in which they agreed not to make any more claims for the land.
Now the encroachment into the land is not only confined to the oil palm plantation but also involves an encroachment into the rubber plantation owned by the villagers. Batin Nek Asang is worried that with each passing day, more and more of the ancestral land of the Indigenous People of Sungai Kelubi is being encroached into and taken away from them.
He had already sent a letter to the Selangor government to protest the invasion through their representative. Until now, however, no action has been taken by the Selangor government to solve the problem of the oil palm estate land of Kampung Orang Asli Sungai Kelubi.
Batin Nek bin Asang regrets the lack of action by any quarter on his behalf, while the land of the villagers is still being encroached into and their ancestral land shrinks by the day.

When the PR Selangor government first took power after the 2008 GE, they did the rightful thing by dropping a court appeal (by their predecessor) against a court decision that favored a claim made by some orang asli. It was a very noble deed that made me believed that the PR government is more people centric and caring towards those who are poor and powerless. What has become of the Selangor government over time? Remember the outrageous pay rise for the excos? Have power and position gone to their heads so much so that they stopped becoming the champion of the downtrodden or even worse, collaborated in their marginalization like their BN predecessor?
