The Convention on the Prevention and Punishment of the Crime of Genocide in the Gaza Strip (South Africa v Israel) – Request for the indication of provisional measures.
The International Court of Justice in The Hague has delivered its provisional ruling.
Here’s a quick recap of the ICJ ruling, courtesy of Al Jazeera:
- The court says it has jurisdiction to rule in the case.
- The court orders Israel to take measures to prevent acts of genocide in the Gaza Strip, must report back in one month.
- The court says Israel must prevent and punish incitement to genocide in the Strip.
- The court says Israel must allow humanitarian aid into the Strip.
- The court obliges Israel to take more measures to protect Palestinians but does not order it to end military operations in the Strip.
So the ICJ, unlike Israel and the US, takes the stance that genocide is in the offing in Gaza, if not actually taking place. This is important, morally speaking and from the perspective of international law – as it shows up both these nations. Israel now has to take all measures in its power to curb its genocidal actions. Some feel the ICJ decision does not go far enough, as it does not call for a ceasefire. But this almost unanimous historic ruling does put Israel and its accomplices in the ongoing genocide on serious notice.
