The Mufti (Federal Territories) Bill 2024 is set to be debated in the ongoing session of Parliament.

This proposed legislation contains vague and problematic provisions that could have far-reaching implications on our constitutional rights and fundamental freedoms.

While the bill aims to strengthen the mufti’s role, it introduces several concerning elements:

  • Fatwas (religious edicts) could become legally binding, allowing individuals to be punished for actions not classified as crimes under existing Malaysian laws
  • Shifting power dynamics – the Federal Territory fatwa committee could issue binding decisions on “national interest” matters without Parliament’s approval, potentially undermining democratic processes

The bill raises serious questions about how religious rulings intersect with human rights and the Federal Constitution, affecting Malaysia’s diversity and freedoms.
